Job description

Boden Group is working with a specialist PFI provider who is looking to recruit for a senior hire within their commercial function. The business is going through a period of transformation and seeking an experienced professional who possesses PFI experience to lead a small team. The business offers flexible working and boasts a diverse workforce.

Overview of role

Drive commercial delivery within the operational area of responsibility, ensuring that tight commercial management is in place across a number of operational contracts or a large strategic contract. Working alongside the Account Manager, Operational Director and on-site teams and collaboration with other functional teams.

Key Responsibilities/Accountabilities
  • Business As Usual (BAU)
  • To deliver value added activities such as developing contract-supporting documents and contributing to commercial policy and promoting commercial awareness in all colleagues at a level appropriate to their role.
  • To lead on the development and management of contract specific risk registers and any dispute management with suppliers and customers.
  • To provide assurances to the business that the commercial / contractual imperatives on the contract are being adhered to and that risks are being appropriately mitigated.
  • To advise on, and review the ongoing performance of suppliers to commercial terms at account and business level in collaboration with the Regional procurement function.
  • To lead the commercial position on material contractual disputes, working closely with the legal and operational team, laying out the recommended commercial strategy, leading the execution of the commercial plan and negotiating with internal and external stakeholders within given boundaries.

Skills, Experience, Qualifications
  • Legal knowledge with PFI contract forms.
  • Clear understanding of key issues in outsourcing specific to the FM market.
  • Strong FM or construction background.
  • Education and Health Sector Experience.
  • Experience in dealing with construction defects.
  • Understanding and working knowledge of Lifecycle funds.
  • Understanding of PFI Contract Payment Mechanisms.
  • To own the commercial solution with regards to project delivery, ensuring that appropriate contractual arrangements are in place and back to back both upwards to clients and down through the supply chain.
  • To report regularly to the Commercial Director on the progress of assigned matters and capacity and support requirements generally.
  • To prepare supporting materials for regular contract reviews and attending executive performance meetings to support the Operational Directors.
  • To become the trusted point of contact for commercial enquiries from your clients with the ability to resolve and escalate issues appropriately through relationships built with internal contacts including Directors, Finance, Procurement, Project and Technical Assurance colleagues.
