Job Description :

The Intellectual Property Counsel will be responsible for managing Recochem’s extensive global IP portfolio and providing legal advice on a broad range of complex legal and regulatory matters related to intellectual property, marketing, advertising, and privacy. The successful incumbent will also support the business in its compliance efforts and draft, review, and negotiate agreements and contracts related to client-facing materials, providing sound legal risk analysis.

This is a hybrid position, which may be based out of the organization’s head office in Montreal, Quebec, or its regional office in Milton, Ontario.

Responsibilities :

• Support to the General Counsel and business units by providing strategic legal and compliance advice, especially concerning the patent, trademark, and copyright portfolio.
• Manage the organization’s global intellectual property portfolio, including overseeing legal team members and outside counsel across multiple jurisdictions.
• Advise on the protection of intellectual property assets and devise cost-effective strategies to maximize coverage.
• Draft, review, analyze, and advise on transactional and commercial agreements, including license agreements.
• Develop and enhance agreement templates.
• Review marketing materials and product labels.
• Maintain current knowledge of laws related to IP, marketing, advertising, and privacy; monitor legal trends; and provide internal training on these topics.
• Advise on consumer litigation trends, marketing strategies, and product claims.
• Assist in analyzing legal and compliance requirements and risks associated with organizational activities.
• Research and respond to legal inquiries from internal clients regarding IP and compliance matters, advising on appropriate legal actions.
• Undertake other duties as requested.

Qualifications & Skills Requirements :

• JD from a recognized law school and licensed to practice law in Canada or the U.S.
• 5+ years of post-qualification experience, with expertise in IP, advertising, marketing, and regulatory compliance, either as in-house counsel or at a law firm.
• Strong client skills, ability to work independently, adaptability, and capacity to thrive in a fast-paced environment.
• Effective communication skills across various formats and audiences.
• Bilingualism in English and French is highly desired.
• Registration as a Patent and Trademark Agent and related expertise is a plus.
