Formación

  • 8+ years' experience in commercial law at a top-tier law firm or international in-house legal department.

MAIN RESPONSIBILITIES

Canadian Solar is seeking an experienced commercial lawyer to lead its EMEA legal team. The ideal candidate will be a confident self-starter with strong interpersonal and organizational skills, capable of providing sound legal advice, exercising good business judgment, and working effectively with senior management, outside counsel, and customers.

LEGAL
  • Structure, negotiate, and draft complex agreements for sales of PV products (PV modules, battery energy storage systems, inverters) and PV turnkey solutions.
  • Draft and negotiate other agreements such as procurement, operation and maintenance, and intercompany agreements.
  • Advise on security arrangements for large transactions, including letters of credit, standby letters of credit, and parent company guarantees.
  • Communicate legal risks and obligations to relevant business and operational teams in the EMEA region.
  • Ensure compliance with applicable EU laws, such as Batteries Regulation and Waste Electrical and Electronic Equipment Directive, at the member state level.
  • Develop and implement legal policies, processes, and contract templates.
  • Drive the utilization of AI solutions within the Legal Team.
  • Manage a team of commercial lawyers in the region (Spanish, English, and German qualified).
  • Coordinate outside counsel to balance legal costs with business goals.
  • Ensure all activities comply with Canadian Solar policies, codes, and procedures.
COMPLIANCE
  • Maintain comprehensive compliance programs, data, records, and training within the EMEA region.
  • Provide input on customer compliance requirements and review related clauses in contracts.
  • Manage anti-bribery, anti-corruption, and KYC due diligence processes for suppliers and customers, including risk assessments.
  • Advise on compliance matters and risks to operational functions and senior management.
  • Prepare regular compliance reports for senior management.
  • Collaborate on compliance issues such as sanctions, cybersecurity, privacy, and conflicts of interest.
  • Manage compliance reviews, whistleblower investigations, and government communications.
  • Oversee data protection policies and processes, ensuring GDPR compliance.
COMPETENCIES
  • Qualified practicing commercial lawyer (qualified in England & Wales, Spain, France, or Germany).
  • Minimum of 8 years' experience in commercial law at a top-tier law firm or international in-house legal department, including drafting and negotiating sales contracts.
  • Extensive knowledge of cross-border trade transactions, international payment systems, transportation, tariffs, duties, product liability, and IP laws.
  • Experience in the solar renewables sector, EPC contracts, disputes, or product law is advantageous.
LANGUAGES
  • Bilingual in English and Spanish or German; additional European languages are a plus.
