Jobtailor seeks an experienced commercial litigation attorney to direct all phases of litigation from pre-suit investigation through trial and post-judgment enforcement. You will handle disputes related to MCA agreements, debt collection, and creditor rights, and draft the necessary pleadings and motions.

Expect to advise lenders on risk, recovery strategies, and regulatory compliance in a fast-paced environment.

Qualifikationen

• 5+ years of dedicated experience in commercial litigation, specifically focusing on MCA litigation, debt collection, and creditors’ rights
• Active bar admission in good standing in the primary operating jurisdiction
• Uniform Commercial Code (UCC) Articles 3 and 9 understanding
• Experience in motion practice, trials, and emergency relief hearings
• Ability to manage a robust caseload independently in a fast-paced environment
• Familiarity with bankruptcy proceedings (Chapter 7, 11, 13) and related adversary proceedings

• Advise lenders, funding companies, and financial institutions on risk mitigation, portfolio recovery, and compliance with commercial finance laws

Represent clients at oral arguments, hearings, depositions, mediations, and trial proceedings

Advise lenders, funding companies, and financial institutions on risk mitigation, portfolio recovery, and compliance with commercial finance laws

Requirements

• Must be licensed in the state of Texas and live in Houston or surrounding areas
• Juris Doctor (JD) degree from an accredited law school
• Active bar admission in good standing in the primary operating jurisdiction
• 5+ years of dedicated experience in commercial litigation, specifically focusing on MCA litigation, debt collection, and creditors’ rights
• In-depth understanding of Uniform Commercial Code (UCC) Articles 3 and 9, state enforcement of judgment procedures, and commercial contract law
• Demonstrated track record of motion practice, trial experience, and emergency relief hearings
• Ability to manage a robust caseload independently while maintaining high attention to detail in a fast-paced environment
• Familiarity with bankruptcy proceedings, including Chapter 7, 11, and 13 cases, adversary proceedings, and motions for relief from stay
• Experience navigating regulatory updates affecting the MCA and alternative finance industry
