Job summary

KSI Law in Markham, ON, seeks a Mortgage Enforcement Lawyer with 3–6 years of Ontario post-call experience to lead power of sale actions, default litigation, and title disputes from start to finish on an active book of business.

As a senior associate, you will manage files, supervise junior lawyers and paralegals, interact with institutional clients, and ensure compliance with the Mortgages Act and related statutes.

Qualifications

• Licensed to practice law in Ontario (LSO).
• 3–6 years post-call litigation or real estate experience in Ontario.

Responsibilities

• Take carriage of mortgage enforcement files, including power of sale and judicial sale matters.
• Appear as lead counsel on motions, summary judgments, and Writs of Possession.
• Prepare and oversee service of Notices of Sale under Mortgages Act and mortgage instruments.
• Manage redemption periods and calculate redemption amounts.
• Direct power of sale proceedings and advise on receivership or foreclosure as needed.
• Review title searches to confirm priority and identify encumbrances.
• Monitor insolvency events and advise on automatic stay under the BIA.
• Pursue deficiency claims where sale proceeds do not fully satisfy debt.

Compensation: $95,000–$130,000 annually

KSI Law is trusted counsel to a robust roster of institutional clients in their mortgage enforcement proceedings. As Mortgage Enforcement Lawyer, you will step directly into that relationship — leading power of sale actions, default litigation, and title disputes from start to finish on an active, established book of business.

Key Responsibilities

• Taking immediate carriage of an active portfolio of mortgage enforcement, power of sale, and judicial sale files on behalf of KSI Law's institutional clients.
• Appearing as lead counsel on motions, summary judgment applications, and Writs of Possession before the Ontario Superior Court of Justice.
• Preparing, issuing, and overseeing service of Notices of Sale in accordance with the Mortgages Act (Ontario) and the terms of each mortgage instrument.
• Managing statutory and contractual redemption periods, including calculating and verifying redemption amounts.
• Directing power of sale proceedings through to completion, and advising on judicial sale or foreclosure as an alternative remedy in more complex or contested files.
• Reviewing title and priority searches to confirm mortgage priority and identify subsequent encumbrances or registered interests requiring discharge or notice.
• Monitoring files for bankruptcy filings, consumer proposals, or other insolvency events triggering an automatic stay under the Bankruptcy and Insolvency Act, and advising on next steps.
• Assessing and pursuing deficiency claims where sale proceeds do not fully satisfy the amount owing, including asset tracing, garnishments, and examinations in aid of execution.
• Advising on receivership as an enforcement option for income-producing commercial mortgage security.
• Overseeing accurate calculation and recovery of legal costs and enforcement expenses in accordance with the mortgage instrument.
• Supervising Jr. lawyers and legal support staff in carriage of active mortgage enforcement files.
• Reviewing and approving legal notices and enforcement strategies prepared by supporting paralegals and legal staff.
• Acting as primary point of contact for institutional clients on active files, providing clear status updates and risk-managed advice.

What You'll Bring

• Licensed to practice law in Ontario (LSO), in good standing.
• 3–6 years of post-call litigation or real estate experience in Ontario; exposure to debtor/creditor law or secured recovery highly valued.
• Solid working knowledge of the Mortgages Act (Ontario), including statutory notice and redemption requirements governing power of sale proceedings.
• Familiarity with Ontario's Land Titles and Registry systems, including electronic registration of enforcement-related instruments.
• Working knowledge of the Bankruptcy and Insolvency Act, particularly the automatic stay provisions triggered by bankruptcy and consumer proposal filings.
• Experience with, or strong working knowledge of, receivership as a remedy in commercial mortgage enforcement.
• Ability to assess and pursue deficiency claims following a sale that doesn't fully satisfy the debt.
• Strong analytical and file-management skills, with the ability to manage a high volume of legal-stage files concurrently and independently, with partner-level support available for strategic decisions.
• Experience supervising paralegals or legal support staff.
