Job summary

KSI Law in Markham, ON, seeks a Mortgage Enforcement Lawyer with 3–6 years of Ontario post-call experience to lead power of sale actions, default litigation, and title disputes from start to finish on an active book of business.

As a senior associate, you will manage files, supervise junior lawyers and paralegals, interact with institutional clients, and ensure compliance with the Mortgages Act and related statutes.

Qualifications

  • Licensed to practice law in Ontario (LSO).
  • 3–6 years post-call litigation or real estate experience in Ontario.

Responsibilities

  • Take carriage of mortgage enforcement files, including power of sale and judicial sale matters.
  • Appear as lead counsel on motions, summary judgments, and Writs of Possession.
  • Prepare and oversee service of Notices of Sale under Mortgages Act and mortgage instruments.
  • Manage redemption periods and calculate redemption amounts.
  • Direct power of sale proceedings and advise on receivership or foreclosure as needed.
  • Review title searches to confirm priority and identify encumbrances.
  • Monitor insolvency events and advise on automatic stay under the BIA.
  • Pursue deficiency claims where sale proceeds do not fully satisfy debt.
