Job description

Our client, a world-class financial services institution with a more personalized approach to financial solutions for professionals, small business owners, and institutions, has exclusively retained Solutus Legal Search to assist the executives with their search for a VP, Legal or General Counsel (depending on experience). The ideal candidate will reside in Florida and go into the South Florida office semi-regularly. The company is open to considering candidates residing on the East Coast who are willing to travel to the office as needed.

This legal executive will possess substantial experience in the financial services industry, including consumer financial services. At least 12+ years of legal experience in consumer lending with a fintech or specialized lending company is required. Additional experience with a top law firm and/or a relevant regulatory agency is preferred. They will possess strong knowledge of and experience interpreting and advising on the appropriate legal and compliance measures related to state and federal consumer protection laws and regulations, including, UDAAP, TCPA, TILA, GLBA and have experience working with financial regulators including state banking departments, CFPB, FTC, FDIC, and OCC. This individual will manage a small team of legal professionals, so management experience is a strong plus.

The person in this role will be a creative problem solver with a positive mental attitude able to tackle challenges head-on, pivot quickly, and execute results.

Responsibilities include:

1. Work across cross-functional teams to provide legal expertise and advise on all legal topics in addition to proactively anticipating legal issues.
2. Provide legal support to the company’s consumer financial services business teams.
3. Work cross functionally to ensure compliance with state and federal consumer protection and lending laws and regulations.
4. Effectively grow and mentor an internal team of business-oriented legal professionals and manage outside counsel.
5. Serve as the resident expert in legal, regulatory and compliance matters impacting specialty finance and consumer finance on the state and federal level.
6. Advise on licensing and corporate registration requirements for multi-state financial products and services.
7. Monitor state and federal legal and regulatory changes and work with the business to operationalize programs and policies in response to legal/regulatory changes.

Required Qualifications:

1. Juris Doctor (JD) degree from an accredited law school.
2. Current member in good standing of at least one State bar with the ability to serve as in house registered counsel in Florida. Florida Bar membership preferred.
3. Minimum of 12 years of experience in legal practice, with expertise in consumer lending regulations and laws.
4. Ability to assist the business partners in maintaining compliance without sacrificing innovation or speed.
5. Substantial knowledge of and experience interpreting and advising on state and federal consumer protection laws and regulations, including but not limited to, UDAAP, TCPA, GLBA, and any state-level statutory and regulatory counterparts.
6. Overall broad legal knowledge of legal issues such as regulatory, corporate, litigation, employment, compliance, etc.
7. Ability to thrive independently and as part of a dynamic, collaborative team.
8. Ability to assess risks, provide thoughtful, pragmatic advice in an environment that doesn’t rely on “cookie-cutter contracts” or canned documents.
