Role Purpose

The Superintendent, Procurement and Contracts provides owner-side leadership for procurement, contracting, and commercial management activities supporting the Company’s capital and exploration projects. Reporting to the Senior Director of Project Controls, this role develops procurement and contracting strategies, oversees major sourcing and contract activities, and protects the Company’s commercial interests throughout the project lifecycle. As the Company utilizes an Engineering, Procurement and Construction Management (EPCM) delivery model, this position serves as the primary Owner counterpart to the EPCM procurement and contracts organization. The Superintendent will provide oversight and to ensure EPCM activities align with Company requirements, delegated authorities, project objectives, commercial strategy, and applicable grant funding award obligations. Success in this role means combining strong commercial judgment with practical capital project experience, maintaining disciplined and auditable procurement practices, and working collaboratively across Project Management, Engineering, Construction, Project Controls, Finance, Legal, contractors, and suppliers while embedding our values of Safety, Respect, Integrity, Adaptability, and Achievement.

Key Responsibilities

Leadership

• Provide functional leadership for procurement, contracts, and commercial management activities.
• Serve as a trusted commercial advisor to leadership on procurement strategy, contracting approaches, major commitments, changes, claims, and supplier or contractor risk.
• Promote disciplined decision-making, clear accountability, teamwork, and effective communication across the Owner and EPCM project teams.
• Demonstrate visible safety leadership and ensure commercial decisions support safe and responsible project execution.
• Performs other duties as assigned.

Project Procurement & Contracting Strategy

• Lead development and implementation of project procurement and contracting strategies aligned with the project execution plan, schedule, risk profile, and commercial objectives.
• Develop and maintain contracting and procurement plans, including package strategies, sourcing approaches, bidder strategies, procurement schedules, and long-lead equipment priorities.
• Evaluate and recommend appropriate commercial and contracting models, including lump-sum, unit-rate, reimbursable, equipment supply, professional services, and construction contracts.
• Assess contractor and supplier capability, market capacity, commercial risk, and other factors that may affect procurement strategy or project execution.

EPCM Oversight & Commercial Management

• Serve as the primary Owner interface with EPCM procurement, contracts, and commercial management personnel.
• Provide Owner oversight of EPCM sourcing, tendering, commercial evaluation, negotiation, contract award, contract administration, and closeout activities.
• Review and challenge EPCM recommendations related to contracting strategies, bidder lists, commercial evaluations, contract awards, changes, claims, and commercial settlements.
• Ensure the EPCM implements applicable Owner requirements arising from federal funding awards, including procurement restrictions, documentation standards, contractual flow-downs, and approval processes.
• Establish reporting and performance expectations for EPCM procurement and contracts activities and identify areas requiring corrective action or management attention.

Sourcing, Contracting & Contract Administration

• Oversee sourcing and competitive tendering for major project contracts, equipment, materials, and services.
• Review procurement packages, bidder qualifications, commercial terms, bid evaluations, exceptions, and recommendations for award.
• Lead or participate in commercial negotiations for significant commitments and coordinate with Legal on material contractual terms and risks.
• Oversee contract administration, including notices, amendments, payment provisions, changes, claims, disputes, warranties, and closeout.
• Lead or support evaluation and negotiation of significant contractor changes, claims, and commercial settlements, with an emphasis on early identification and dispute avoidance.

Project Controls Integration

• Partner closely with Project Controls to ensure commitments, approved and pending changes, claims, payment milestones, and commercial exposures are accurately and timely reflected in project cost forecasts and reporting.
• Maintain visibility of contract and purchase order commitments and support reconciliation of commercial information with project controls systems and reporting.
• Provide commercial inputs to procurement schedules, commitment and cash-flow forecasts, change management, and potential cost exposure while overall project budget, forecast, EAC, contingency, and cost reporting remain within Project Controls.

Governance & Compliance

• Develop and maintain procurement and contracting procedures, workflows, templates, approval requirements, and commercial governance standards.
• Ensure procurement and contracting activities comply with applicable requirements, restrictions, and conditions associated with federal funding awards, including Department of Energy and Department of War funding.
• Translate applicable funding award requirements into practical procurement procedures, approval workflows, documentation standards, contract terms, and supplier or contractor flow-down requirements in coordination with Legal, Finance, and project leadership.
• Maintain competitive-bid documentation, approvals, commercial records, and audit-ready records; support audits, reporting, and information requests related to federally funded procurement and contracting activities.
• Monitor contractor and supplier commercial performance and support corrective action where contractual, commercial, or applicable funding requirements are not being met.

Required Experience & Qualifications

• Minimum of 10 years of progressive procurement, contracts, commercial management, or supply chain experience supporting major capital projects, with demonstrated leadership responsibility.
• Prior experience in mining, minerals processing, construction, energy, heavy industrial, or another capital-intensive environment is strongly preferred.
• Demonstrated experience working in an Owner, EPCM, or EPC environment and strong understanding of Owner and delivery-partner commercial accountabilities is preferred.
• Proven experience leading complex commercial negotiations and evaluating contract changes, claims, commercial exceptions, and contractor entitlement.
• Strong knowledge of capital project contracting strategies and commercial models, including lump-sum, unit-rate, reimbursable, equipment supply, professional services, and construction contracts.
• Experience supporting federally funded capital projects or procurement compliance requirements is preferred.
• Strong understanding of the relationship between procurement, contracts, project controls, cost forecasting, scheduling, change management, and project execution.
• Strong analytical, negotiation, communication, and stakeholder-management skills, with the ability to work effectively across Owner, EPCM, contractor, supplier, Finance, and Legal teams.
• Bachelor's degree in engineering, construction management, business, supply chain, finance, or a related field (or equivalent combination of education and experience).
• Residency (or willingness to move) to Michigan’s Upper Peninsula.
