Job summary

Civic Recruitment Limited is helping a Local Authority recruit a seasoned Solicitor to join its Adult Social Care Legal Team on a temporary basis. The role focuses on Court of Protection cases, while also advising Adult Social Care services.

The successful candidate will manage a full caseload independently, draft court documents, and deliver practical legal guidance with a proactive, autonomous approach in a fully remote setting.

Qualifications

• Qualified to practise in England and Wales.
• Extensive experience in Adult Social Care Law.
• Proven track record in Court of Protection work.
• Able to manage a full caseload independently.
• Experienced providing legal advice to Local Authority departments.
• Skilled at drafting court documents, applications and bundles.
• Strong drafting, advocacy and communication abilities.
• Capable of remote, independent work and admin tasks.

Responsibilities

• Oversee Court of Protection cases from start to finish.
• Provide welfare and property/ affairs legal counsel.
• Draft applications, statements, pleadings and bundles.
• Prepare court bundles and manage case progression.
• Coordinate with Counsel, Court, Social Workers and others.
• Represent the Local Authority at hearings when needed.
• Advise Adult Social Care teams and interpret statutory duties.
• Support safeguarding and complex care matters.
• Maintain case records, conduct legal research and provide written advice.

Summary

A Local Authority is in search of a seasoned Solicitor to join its Adult Social Care Legal Team on a temporary basis. This role is centered on Court of Protection cases, while also offering legal counsel and support to Adult Social Care services. The ideal candidate will independently manage their caseload and deliver expert legal advice on intricate adult social care issues. This position demands a proactive and autonomous lawyer capable of handling cases from start to finish, including administrative and document preparation tasks as needed.

Key Responsibilities

Court of Protection

• Oversee a caseload of Court of Protection cases from start to finish.
• Offer legal counsel on welfare and property and affairs issues.
• Draft applications, witness statements, pleadings, and related documents.
• Prepare court bundles and manage all aspects of case preparation.
• Coordinate with Counsel, the Court, Social Workers, and other relevant parties.
• Represent the Local Authority at hearings when necessary.

Adult Social Care Advice

• Provide legal guidance to Adult Social Care teams.
• Advise on statutory duties and responsibilities under applicable laws.
• Support safeguarding and complex care cases.
• Deliver practical, solution-oriented legal advice to client departments.
• Assist with policy interpretation and legal risk management.

Case Management

• Independently manage a diverse and complex caseload.
• Ensure timely progression of cases within required deadlines.
• Maintain precise case records and documentation.
• Conduct legal research and provide written advice.
• Perform administrative tasks and manage documents related to casework.

Essential Requirements

• Qualified Solicitor, Barrister, or Fellow of CILEX eligible to practice in England and Wales.
• Extensive experience in Adult Social Care Law.
• Proven track record in handling Court of Protection cases.
• Capability to manage a full caseload independently.
• Experience in providing legal advice to Local Authority client departments.
• Proficiency in preparing court documents, applications, and bundles.
• Strong drafting, advocacy, and communication skills.
• Ability to work independently in a remote setting.
• Experience performing administrative and case management duties as needed.

Desirable

• Previous experience in Local Authority legal work.
• Advocacy experience.
• Knowledge of Mental Capacity Act matters.
• Experience advising on safeguarding and complex care issues.
