Position Title: Senior Bankruptcy & Creditors’ Rights Attorney

Position Overview

We are seeking an experienced Bankruptcy & Creditors’ Rights Attorney with at least 5 years of dedicated practice to join our premier business law firm. Our firm is a trusted advisor to financial institutions, commercial lenders, receivers, landlords, equipment lessors, and corporate clients.

This position focuses heavily on representing financial institutions and commercial creditors in complex Chapter 7, 11, and 13 bankruptcy proceedings, out-of-court workouts, debt restructurings, and insolvency litigation. The ideal candidate brings a sophisticated understanding of financial transactions, strong commercial instincts, and proven courtroom advocacy skills.

Key Responsibilities

• Represent institutional lenders, commercial banks, private creditors, equipment lessors, and trustees in bankruptcy proceedings and state/federal insolvency matters.
• Prepare and argue cash collateral motions, relief from stay motions, plan confirmation objections, valuation disputes, and preference/fraudulent transfer defense.
• Negotiate, structure, and draft complex workout agreements, forbearance agreements, and debt restructuring documents.
• Manage adversary proceedings and enforcement litigation from case initiation through trial or negotiated settlement.
• Conduct non-judicial and judicial foreclosures, receiverships, and post-judgment enforcement actions.
• Advise financial institution clients on lender liability risk mitigation and distressed asset strategies.

Qualifications

• Education: Juris Doctor (J.D.) from an accredited law school.
• Bar Admission: Active member in good standing with the State Bar of California
• Experience: 5+ years of dedicated practice in bankruptcy law with a heavy concentration in creditors’ rights and financial institution representation.
• Technical Skills:
• In-depth mastery of the U.S. Bankruptcy Code (especially Chapters 7 and 11) and the California Commercial Code.
• Demonstrated track record handling contested matters, evidentiary hearings, and depositions.
• Exceptional legal drafting, analytical thinking, and negotiation skills.
• Client Service: Strong business acumen with the ability to provide pragmatic, cost-effective solutions for institutional clients.
