Job summary

BJ’s Wholesale Club in Marlborough, MA is seeking a Real Estate Counsel to join our in-house legal team. This hybrid, full-time role supports leases, development, and portfolio transactions for retail locations.

The ideal candidate has 4–7 years of real estate law experience, JD, and MA bar admission, with excellent verbal and written communication. You will draft and negotiate leases, perform diligence, manage outside counsel, and advise internal clients.

Qualifications

• 4–7 years of real estate law experience, preferably with retail industry exposure.
• Bachelor’s degree from an accredited program; J.D. from a top college or university.
• Demonstrated experience as real estate deal counsel, particularly on development deals.
• Excellent verbal and written communication skills.
• Flexible and willing to pitch in with new issues as they arise.
• Ability to prioritize and handle multiple tasks with minimal supervision.
• Team player mindset.

Responsibilities

• Serve as real estate leasing and transaction counsel for retail locations, distribution centers, and other company sites.
• Draft and negotiate leases, purchase and sale agreements, and related real estate documents.
• Provide guidance to in-house clients on lease provisions, environmental issues, and land-use concerns.
• Conduct legal diligence for new locations, including title and survey analysis.
• Manage outside counsel as necessary and assist in related litigation and dispute resolution.
• Update real estate documents and forms; assist in zoning, permitting, and incentives matters.
• Report to the Assistant General Counsel, Real Estate.

BJ’s Wholesale Club (NYSE: BJ) is a Fortune 250 company. The Real Estate Counsel plays an integral role in supporting BJ’s real estate portfolio, growth, and operations, and must demonstrate strong commercial and legal judgment along with a collaborative, team-first approach. The Real Estate Counsel negotiates and drafts leases, purchase and sale agreements, and other commercial real estate documents; advises internal business partners on property-related legal and operational issues; and conducts real estate diligence for new locations.

Major Tasks, Responsibilities, and Key Accountabilities:

• Serve as real estate leasing and transaction counsel concerning retail locations, distribution centers, gas stations, and other company locations

• Negotiate and draft leases, purchase and sale agreements, and various other commercial real estate documents, including lease amendments, ground leases, condominium documents, development agreements, reciprocal easement agreements, construction agreements, subleases, SNDAs, estoppel certificates, letter agreements, and default notices

• Provide prompt legal guidance to various in-house clients (including property development, construction, operations, finance, and risk) regarding lease and easement provisions, operational issues, violations, signage, construction issues, access agreements, landlord/tenant disputes, and repair and maintenance issues

• Conduct legal diligence for new locations, including analyzing title and survey and identifying potential environmental risk and liability

• Work with and manage outside counsel as necessary

• Assist in management of real estate related litigation and dispute resolution

• Assist in updating the Company’s real estate documents and forms and legal processes

• Assist local land use counsel with respect to zoning, permitting, incentives, and similar matters

• Report to the Assistant General Counsel, Real Estate
  

Qualifications:

• 4-7 years of real estate law experience at an AmLaw 100 firm and/or in-house environment, preferably with retail industry experience

• Bachelor's degree from a top college or university; J.D. from a top college or university

• Demonstrated experience as real estate deal counsel, particularly as developer-side counsel on development deals, preferably with some or all such experience on behalf of retail organization(s)

• Excellent verbal and written communication skills

• Flexible and willing to pitch in wherever new issues arise

• Ability to prioritize and handle multiple tasks and projects with limited supervision

• Team player with a sense of humor

Licensures and Certifications:

• Admitted to MA bar association, or eligible to practice pursuant to MA SJC Rule 4:02 (9)

In accordance with the Pay Transparency requirements, the following represents a good faith estimate of the compensation range for this position. At BJ’s Wholesale Club, we carefully consider a wide range of non-discriminatory factors when determining salary. Actual salaries will vary depending on factors including but not limited to location, education, experience, and qualifications. The pay range for this position is $175,000.00 - $200,000.00

This is a hybrid role. Tuesday through Thursday are in-office days at BJ's Club Support Center in Marlborough, MA and Monday and Friday are remote days.
