BJ’s Wholesale Club, Marlborough, MA, seeks a Real Estate Counsel to support the real estate portfolio, negotiate leases, and draft agreements while advising internal teams on property matters.

The role requires 4–7 years of real estate law experience and a JD from a top school, with strong negotiation and communication skills. This hybrid role reports to the Assistant General Counsel, Real Estate, with in-office days in Marlborough and remote days as needed.

Qualifications

• 4-7 years of real estate law experience at an AmLaw 100 firm and/or in-house environment.
• Bachelor's degree from a top college or university; JD from a top college or university.
• Demonstrated experience as real estate deal counsel, particularly on development deals for retail organizations.
• Excellent verbal and written communication skills.
• Flexible and willing to pitch in wherever new issues arise.
• Ability to prioritize and handle multiple tasks with limited supervision.
• Team player with a sense of humor.

Responsibilities

• Serve as real estate leasing and transaction counsel concerning retail locations, distribution centers, gas stations, and other company locations.
• Negotiate and draft leases, purchase and sale agreements, and various other commercial real estate documents.
• Provide prompt legal guidance to in-house clients on property-related issues; advise on lease provisions, compliance and risk.
• Conduct legal diligence for new locations, including title and survey review and environmental risk identification.
• Work with and manage outside counsel as necessary.
• Assist in updating the Company’s real estate documents and forms and legal processes.
• Report to the Assistant General Counsel, Real Estate.

The Real Estate Counsel plays an integral role in supporting BJ’s real estate portfolio, growth, and operations, and must demonstrate strong commercial and legal judgment along with a collaborative, team-first approach. The Real Estate Counsel negotiates and drafts leases, purchase and sale agreements, and other commercial real estate documents; advises internal business partners on property-related legal and operational issues; and conducts real estate diligence for new locations.

Major Tasks, Responsibilities, and Key Accountabilities

Serve as real estate leasing and transaction counsel concerning retail locations, distribution centers, gas stations, and other company locations Negotiate and draft leases, purchase and sale agreements, and various other commercial real estate documents, including lease amendments, ground leases, condominium documents, development agreements, reciprocal easement agreements, construction agreements, subleases, SNDAs, estoppel certificates, letter agreements, and default notices Provide prompt legal guidance to various in-house clients (including property development, construction, operations, finance, and risk) regarding lease and easement provisions, operational issues, violations, signage, construction issues, access agreements, landlord/tenant disputes, and repair and maintenance issues Conduct legal diligence for new locations, including analyzing title and survey and identifying potential environmental risk and liability Work with and manage outside counsel as necessary Assist in management of real estate related litigation and dispute resolution Assist in updating the Company’s real estate documents and forms and legal processes Assist local land use counsel with respect to zoning, permitting, incentives, and similar matters Report to the Assistant General Counsel, Real Estate

Qualifications

• 4-7 years of real estate law experience at an AmLaw 100 firm and/or in-house environment, preferably with retail industry experience
• Bachelor's degree from a top college or university; J.D. from a top college or university
• Demonstrated experience as real estate deal counsel, particularly as developer-side counsel on development deals, preferably with some or all such experience on behalf of retail organization(s)
• Excellent verbal and written communication skills
• Flexible and willing to pitch in wherever new issues arise
• Ability to prioritize and handle multiple tasks and projects with limited supervision
• Team player with a sense of humor

Licensures and Certifications

• Admitted to MA bar association, or eligible to practice pursuant to MA SJC Rule 4:02 (9)

In accordance with the Pay Transparency requirements, the following represents a good faith estimate of the compensation range for this position. At BJ’s Wholesale Club, we carefully consider a wide range of non-discriminatory factors when determining salary. Actual salaries will vary depending on factors including but not limited to location, education, experience, and qualifications. The pay range for this position is $175,000.00 - $200,000.00

This is a hybrid role. Tuesday through Thursday are in-office days at BJ's Club Support Center in Marlborough, MA and Monday and Friday are remote days.
