Qualifications

• Active Virginia law license in good standing or eligibility to waive promptly.
• 3+ years of personal injury experience with demand-writing and adjuster negotiation.
• Strong writing skills and attention to detail.
• Familiarity with case-management software such as CloudLex.

Responsibilities

• Track pre-litigation files against firm timelines and ensure progress milestones are met.
• Review and approve demands with full documentation of liability, damages, and future care.
• Negotiate with insurance adjusters and advise clients on offers.
• Identify cases that should move to litigation and hand off with a clean file before statute expiry.
• Maintain zero-error tracking of statutes, notices, and related requirements with audits.
• Lead weekly pre-litigation pipeline reviews and train staff on templates and processes.
• Oversee lien resolution (Medicare/Medicaid/ERISA) and review settlement statements.
• Assist with some litigation tasks when needed, while focusing on pre-suit work.

Job description

Correll Law Firm, PC, an established and growing Virginia personal injury firm, is hiring a Pre-Litigation Attorney. You will own the speed and quality of every pre-suit case, from signed client through settlement or handoff to litigation.

You will lead the pre-litigation team, including case managers, medical records and lien staff, and demand writers. Your job is to keep every file moving on schedule, make every demand strong and complete, and recover full value for our clients, without filing suit whenever possible.

Responsibilities:

• - Pre-suit velocity: Track every pre-litigation file against firm timelines, including treatment status, records and bills requested and received, demand-ready date, demand sent, and offer received. Find stalled files every week and get them moving.
• - Demand quality: Review and approve every demand before it goes out. Liability, damages, medical specials, future care, and lost wages must be fully documented and persuasive.
• - Negotiation: Negotiate directly with insurance adjusters, evaluate offers, and advise clients.
• - Litigation decisions: Identify early the cases that will not resolve pre-suit, and hand them to litigation with a clean file well before the statute of limitations.
• - Deadline control: Zero-error tracking of statutes of limitations, governmental notice, and UM/UIM notice requirements, with monthly two-person audits.
• - Team leadership: Run weekly pre-litigation pipeline reviews, set and track scorecard numbers, and train staff on firm templates and processes.
• - Liens and settlements: Oversee lien resolution (Medicare, Medicaid, ERISA, and provider liens) and review settlement statements for accuracy.
• - Litigation support: Handle some litigation work as needed, such as filing suit, discovery, motions, depositions, and court appearances, although pre-suit remains the primary focus of this role.

• - Base salary of $90,000 - $105,000 per year, depending on experience
