Base salary plus commission with production bonuses; compensation ranges from $90,000 to $130,000 per year. The role requires an active Maryland bar license, plaintiff PI experience, and the ability to supervise staff.

Responsibilities

  • Own an assigned pre-litigation docket from treatment through resolution, setting liability analysis, damages theory, and target timeline at intake handoff.
  • Evaluate every file against Maryland contributory negligence exposure.
  • Track statute of limitations deadlines and drive resolution.
  • Confirm client treatment is complete, documented, and appropriate before demand.
  • Direct and quality-control the legal assistants on your files and serve as their resource.
  • Audit files against Pre-Litigation Checklist before they advance.
  • Draft and finalize demand packages and damages narratives based on medical records.
  • Negotiate with adjusters and determine case valuation.
  • Resolve Medicare/Medicaid, ERISA, private liens; train to run independently.
  • Present settlement authority and net recovery to clients clearly.
  • Decide which files settle pre-suit and which transfer to litigation.

WGK Personal Injury Lawyers is hiring a Pre-Litigation Attorney to own personal injury files from treatment through settlement. You carry your own docket. You make the calls on liability, valuation, demand posture, and when a case leaves pre-suit. Most of our volume is auto and auto-adjacent (pedestrian, bicycle, motorcycle, truck, scooter), with premises liability and dog bite matters throughout. A team of pre-litigation legal assistants runs the administrative engine on your files: treatment set-up, records and bills, claim openings, PIP and MedPay submissions, wage documentation. You direct that work. You do not do it. This seat is built to develop you. If you have plaintiff PI experience but have not yet run Medicare and Medicaid lien resolution start to finish, or have not supervised support staff, we will train you. What we need on day one is judgment, drafting ability, and the willingness to own a file. We are an AI-forward firm. You will use AI tools for demand drafting, medical chronologies, and case analysis, with your judgment on every output. Compensation and Commission: Your compensation is a base salary plus commission on every case you resolve. Commission is a percentage of the attorney fee the firm collects, calculated before case costs come out, and paid monthly. Cases settled before suit: 3% Cases settled after suit is filed, at mediation, or through arbitration: 5% Cases tried to a verdict above the last written offer: 8% Case costs, liens, and subrogation do not reduce your commission. There is an annual production bonus on top of these rates for attorneys who exceed collected fee thresholds. If you bring your own case into the firm from outside our marketing and referral channels, total commission on that case is 30% of the attorney fee. Your base salary is set at offer and confirmed in writing. Compensation: $90,000 - $130,000 yearly (base salary + commission)

Responsibilities
  • Own an assigned pre-litigation docket from treatment through resolution, setting liability analysis, damages theory, and target timeline at intake handoff
  • Evaluate every file against Maryland contributory negligence exposure early, not at the demand stage
  • Track statute of limitations deadlines and drive resolution well ahead of them
  • Confirm each client's course of treatment is complete, appropriate, and documented before demand issues
  • Direct and quality-control the legal assistants on your files, coach them directly, and serve as their resource on medical, coverage, and procedural questions
  • Audit files against our Pre-Litigation Checklist before they advance: police report, body-worn camera and CCTV footage, photographs, witnesses, liability acceptance, policy limits, and PIP status, all documented in Filevine
  • Draft and finalize demand packages and damages narratives built on the actual medical record, not a template
  • Negotiate directly with adjusters, hold your valuation, and know when a case is being lowballed
  • Resolve Medicare, Medicaid, ERISA, private liens, subrogation claims, and letters of protection, cross-checked against the course of treatment before disbursement. We train you on this and expect you to run it independently
  • Present settlement authority and net recovery to clients clearly and honestly
  • Decide which files settle pre-suit and which transfer to litigation, hand off complete litigation-ready files, and personally walk the client through the transition
Qualifications

Active Maryland bar license in good standing (required) Plaintiff-side personal injury experience; pre-litigation case handling strongly preferred Experience drafting demand packages and communicating directly with adjusters Working knowledge of Maryland PIP, MedPay, UM and UIM coverage, and the mechanics of policy limits demands Familiarity with Medicare, Medicaid, and private lien resolution, or the aptitude to learn it quickly with training Interest in supervising and developing support staff, whether or not you have done it before Comfort using AI drafting and analysis tools; prior experience preferred, willingness to learn required Ability to manage a high-volume docket and keep files moving without being chased Strong written communication and drafting skills Filevine experience, D.C. bar admission, and Spanish fluency are pluses Compensation: $90,000 - $130,000 yearly
