Job summary

General Description

Performs investigative and enforcement work according to the Texas Alcoholic Beverage Code (Code). Work involves inspecting, investigating, and regulating the alcoholic beverage industry by enforcing the Code. May provide guidance to others. Works under general supervision, with moderate latitude for the use of initiative and independent judgment.

Essential Job Functions

Enforces provisions of the Code, the Texas Penal Code, and other applicable statutes; and may be required to interpret and provide information on Texas laws, rules, and regulations relating to the alcohol industry, as well as those concerning the welfare and safety of the general public.

• Ensures public safety at licensed and permitted locations and may participate in undercover operations or surveillance work to investigate organized crime.
• Inspects licensed premises and investigates complaints concerning violations of the state’s alcoholic beverage laws.
• Gathers intelligence and evidence to determine if violations occurred and whether criminal or administrative charges are warranted.

Conducts independent investigations of criminal and administrative violations committed on or about TABC licensed premises by licensees, their agents or employees, and members of the general public.

• Conducts searches, seizes illicit alcoholic beverages and other contraband, and executes arrests.
• Assists other law enforcement agencies in the investigation, preparation, and prosecution of alcohol-related cases.
• Prepares and executes search warrants.

Prepares reports of investigations; files administrative and criminal cases for prosecution with the appropriate authorities; and maintains records of investigative cases in the secure systems designated for maintenance of such information.

Assists in the prosecution of cases filed by collecting, documenting, and evaluating evidence to formulate defensible investigative conclusions, and testifies in court and in other official proceedings.

May handle or assist in the initial processing of applications for licenses and permits. May present training or teach awareness programs. May provide guidance to others.

Minimum Qualifications

• Must be 21 years of Age**

Education: Graduation from high school or its equivalent (GED)

Applicable Substitutions

In addition to these requirements, applicants must meet one of the following four options:

Option 1

Four years full-time experience as a commissioned peace officer (excluding probation, corrections and/or security experience).

Option 2

Bachelor’s degree from an accredited four-year college or university.

Option 3

Four years military service.

Option 4

Any combination of required education, military service, and law enforcement experience which equals to at least four years.

Preferred Qualifications

Graduation from an accredited four-year college or university with major coursework in criminal justice, criminology, police science, or a related field is generally preferred.

Registration, Certification Or Licensure

• Possess a valid Texas driver’s license, if applicable
• Must have a Peace Officer license issued by the Texas Commission on Law Enforcement (TCOLE) as per Texas Administrative Code Chapter 217 rule

• Additional certifications may be required to be registered, certified, or licensed in a specialty area.

• Knowledge of the Texas Alcoholic Beverage Code, the Texas Penal Code, and other applicable statutes; of regulatory procedures related to the alcoholic beverage industry; and of investigative and law enforcement methods and practices.

• Ability to exercise independent judgment in determining when there is a reasonable suspicion to detain, when probable cause exists for search and arrest and when force may be used and to what degree.

• Ability to work effectively with agency personnel, other agencies and the public including interactions in person, over the telephone and via electronic means.

Physical Requirements/Supplemental Information

This position predominantly functions in the field working from a police vehicle and inside licensed establishments, but may also work in a standard office environment. Must be able to move around the office to access filing cabinets, office equipment and move up to 20 pounds. Must be able to communicate and exchange information via phone, computer, in person and via electronic media. Must be able to perform repetitive use of a keyboard at a workstation. Must be able to work with overlapping deadlines.

This position is expected to work in the office but may be eligible for situational or hybrid telework schedule upon completion of an initial probationary period. For teleworking, must have a secure, dedicated workspace with internet service, ability to maintain a reliable consistent work schedule and be available for meetings and group collaboration via Microsoft Teams or other platforms/applications during regular business hours.

Certified Peace Officers (CPOs)

• All TABC certified peace officers are required to comply with the physical standards annually as a condition of their employment (Texas Government Code, Chapter 614, Subchapter J, section 614.172).
