General Purpose
The Litigation Manager contributes to the success of PACS operations and client relations by ensuring high quality and expeditious record collection efforts, preparing legal information and responses, and providing support with the legal aspects of case coordination.
- Facilitate and monitor all pre-litigation and current litigation associated with facilities assigned to you
- Act as liaison between facilities and attorneys to facilitate efficient case management towards resolution
- Continuous review of open cases and pre-litigation matters to ensure efficient resolution and to alert General Counsel and escalate issues as needed
- Ensure compliance with legal standards with authorization assignment and requesting of records
- Experience with written discovery, must review/revise interrogatories and written responses thereto and help identify appropriate deponents for deposition notices.
- Manage case coordination, record collection and other work product efforts including, but not limited to:
- Consistent and ongoing facility communications and legal communications
- Record collection, review and analysis
- Secure appropriate authorizations for record requests
- Review facility charts for completeness
- Resolving questions and issues that arise during the pendency of litigation; analyze appropriateness of various legal motions as necessary
- Monitor deadlines and trial dates as appropriate
- Understand and monitor potentially available insurance lines
- Interact with insurance carriers
- Prepare for and attend mediations
- Monitor trials and arbitrations; daily analysis of same
- Provide lessons learned to facilities with legal analysis as to why resolutions occurred the way they did
- Note: For the right candidate, this could be a REMOTE or HYBRID position.
Minimum Requirements
- Bachelor Degree from an accredited college/university required
- Minimum 3-5 years experience in litigation defense, particularly healthcare/personal injury
- The preferred candidate will also need to interact with quality assurance nurses for legal standard of care opinions, analyze same, and make recommendations for resolution.
- Strong familiarity with medical terms, medical issues and ability to understand the standard of care required in skilled nursing homes.
- J.D. preferred
