Job description

We are a commercial collections agency that helps businesses recover outstanding contractual balances and resolve commercial disputes. Our work includes matters in the alternative finance space, including merchant cash advances, revenue-based financing, and related business financing agreements. Our legal and collections teams work closely together to evaluate accounts, negotiate resolutions, pursue litigation, and coordinate judgment enforcement. We value accountability, collaboration, and practical strategies grounded in an understanding of our clients’ businesses.

About the Role

We are seeking a New York City-based attorney to handle a litigation-heavy caseload involving commercial collections, business disputes, and creditor recovery matters, with a particular focus on breach of contract litigation in the alternative finance space, including merchant cash advances, revenue-based financing, and related business financing agreements. This position requires a proactive attorney who can independently manage litigation, negotiate resolutions, appear in court, and work closely with our legal and collections teams.

The ideal candidate will have strong litigation experience, sound business judgment, and an understanding of how businesses operate. Commercial collections experience is preferred. We are seeking someone who can evaluate both the legal merits and practical business considerations of a matter and develop strategies that support efficient, cost-effective recovery.

Key Responsibilities
  • Manage commercial collections and related litigation matters from initial review through resolution, including post-judgment enforcement.
  • Draft, review, and file summonses, complaints, answers, motions, affidavits, discovery demands and responses, settlement agreements, stipulations, and other litigation documents.
  • Appear in court for conferences, hearings, oral arguments, trials, and other proceedings.
  • Develop litigation strategies based on contractual rights, available evidence, defenses, collectability, and the costs and anticipated benefits of pursuing a matter.
  • Negotiate with opposing counsel, business owners, guarantors, and other relevant parties to resolve disputes and secure settlements.
  • Review contracts, account histories, payment records, and supporting documentation to assess claims and prepare matters for litigation.
  • Manage discovery, including preparing and responding to discovery demands and addressing discovery disputes.
  • Pursue judgment enforcement and coordinate asset investigations and other recovery efforts with the team.
  • Work closely with the legal, collections, intake, and operational teams to ensure matters are properly documented, advanced, and resolved.
  • Maintain accurate case records, monitor court deadlines, and provide timely updates regarding case status, strategy, settlement opportunities, and potential exposure.
  • Coordinate with outside counsel when necessary and identify matters requiring escalation or additional review.
Qualifications
  • Juris Doctor from an accredited law school.
  • Active admission to the New York State Bar and good standing.
  • Demonstrated litigation experience, including drafting pleadings and motions, managing cases, and appearing in court.
  • Strong legal research, writing, advocacy, and negotiation skills.
  • Understanding of business operations, commercial transactions, and the financial considerations that influence litigation and settlement decisions.
  • Ability to manage a substantial caseload, prioritize competing deadlines, and exercise independent judgment.
  • Strong attention to detail, responsiveness, and follow-through.
  • Ability to work collaboratively with attorneys and non-attorney team members.
  • Availability to attend court proceedings in New York City and surrounding jurisdictions as needed.
Job Type

Full-time: Monday - Friday

Work Arrangement: Remote

  • Although the position is remote, the attorney must be available to attend court appearances, hearings, depositions, conferences, and other in-person proceedings as required.

Base Salary: $110,000 to $175,000, depending on experience and qualifications.
