General Job Description Position Overview

The Litigation Attorney supports the management of the company's litigation matters, claims, and disputes under the direction of the Litigation Manager. This role assists with managing outside counsel, developing and executing litigation strategies, and providing practical legal advice to minimize legal exposure and support business objectives. The Litigation Attorney is responsible for handling litigation-related matters and processes, conducting legal analysis, and partnering with company leadership and outside counsel to ensure matters are handled effectively and in compliance with applicable laws and company policies.

Primary Responsibilities
  • Handle and support all phases of litigation matters, including pre-litigation disputes, discovery, mediation, arbitration, trial preparation, and settlement negotiations under the direction of the Litigation Manager.
  • Manage assigned litigation matters and claims, including coordinating deadlines, gathering relevant information and documentation, and ensuring timely completion of litigation-related tasks.
  • Work closely with outside counsel on assigned matters to facilitate effective representation, monitor case progress, assist with litigation strategy, and support the efficient delivery of legal services.
  • Investigate and evaluate legal claims and disputes, assess potential liability and risk exposure, and provide recommendations to the Litigation Manager regarding litigation strategy and resolution.
  • Provide practical legal advice and guidance to business divisions and operational teams regarding litigation matters, claims, disputes, and related legal risks.
  • Draft, review, and coordinate responses to legal correspondence, discovery requests, pleadings, subpoenas, demand letters, garnishments, settlement agreements, and other litigation-related documents and legal inquiries.
  • Conduct legal research and analysis regarding litigation issues, applicable laws, procedural requirements, and potential legal exposure.
  • Partner with internal departments to investigate incidents, claims, and potential disputes, including interviewing relevant personnel, gathering documentation, and preserving evidence.
  • Assist with the implementation and maintenance of litigation management processes, reporting procedures, legal holds, and document retention practices.
  • Monitor assigned litigation matters for compliance with applicable federal, state, and local laws, regulations, court rules, and procedural requirements.
  • Maintain accurate and organized litigation files, case records, status reports, reporting metrics, and other litigation-related documentation.
  • Assist with insurance claims and coordinate with insurance carriers, brokers, and outside counsel regarding covered litigation matters.
  • Keep the Litigation Manager informed regarding the status of assigned matters, significant legal developments, potential claim exposure, settlement opportunities, upcoming deadlines, and recommended courses of action.
  • Escalate significant litigation risks, developments, and settlement considerations to the Litigation Manager as appropriate.
  • Perform other duties as assigned.

Strong knowledge of litigation procedures, dispute resolution strategies, and applicable federal, state, and local laws and codes. Excellent analytical, negotiation, and problem-solving skills. Strong written, verbal, and interpersonal communication skills. Ability to manage others and delegate tasks effectively. Ability to manage multiple litigation matters simultaneously in a fast-paced environment. Sound judgment and ability to assess legal and business risks effectively. High level of organization, attention to detail, and accuracy. Ability to work independently while collaborating effectively with leadership and cross-functional teams. Proficiency in Adobe Acrobat and Microsoft Office Suite. Ability to maintain confidentiality and exercise discretion regarding sensitive legal matters. Ability to pass pre-employment screenings such as background and motor vehicle record checks. English speaking, reading, and writing preferred, and required where necessary to perform job duties. Maintain professionalism and a positive, respectful demeanor with customers, coworkers, and business partners.

Education/Experience

Juris Doctorate required. Licensed and in good standing to practice law in the applicable jurisdiction. Minimum of 5 years of litigation experience preferred. Experience in construction, commercial, corporate, auto, and/or employment litigation preferred. Bachelor's degree required. Relevant industry certifications or licenses preferred, and required where necessary to perform job duties. Experience managing outside counsel and legal budgets.

Physical Requirements

Hand movements, including typing. Travel as required to support project and operational needs. Work in a typical office environment, sitting at a desk and performing prolonged computer work, with occasional standing, walking, bending, and reaching. Maintain dependable transportation and consistent, reliable attendance to meet customer service and operational needs. Ability to exercise sound judgment and make independent decisions within established company policies and procedures. Ability to work overtime, modified schedules, or occasional weekends as business needs require. Communicate in person, by phone, and electronically, including on a tablet, smartphone, and other office technology. Perform all work on-site and in person; this is not a remote or hybrid position. Lift, carry, push, and pull at least 25 pounds. This position is not eligible for visa sponsorship or work authorization support. Candidates must be authorized to work in the United States on a full-time basis without current or future need for employer sponsorship.
