Description

We are seeking an experienced Litigation Attorney licensed in Massachusetts with a strong background in the residential foreclosure process. The ideal candidate will have hands‑on experience handling foreclosure‑related litigation, from reviewing case files and titles to representing clients in court. This role offers the opportunity to join a dynamic legal team focused on delivering efficient, compliant, and client‑focused representation in the creditors' rights and foreclosure space.

Essential Functions
  • Possess strong knowledge of residential foreclosure process and general real estate law, including litigation, title curative / title claims, and post-judgment litigation (with preference given to candidates with experience handling FDCPA, RESPA, and TILA claims, as well as creditor rights generally).
  • Review and analyze pre- and post-judgment title issues to ensure marketable title to our clients or identify potential title issues and assess resolution options.
  • Conduct legal research.
  • Draft substantive pleadings, motions, legal opinions, and memoranda.
  • Appear at court hearings, mediations, depositions, and other required appearances on behalf of clients.
  • Analyze cases, propound focused discovery, and assist clients with responses to discovery requests, including identifying responsive documents and reviewing documents for potential issues.
  • Communicate effectively, written and verbally, with clients on issues that may affect foreclosure, provide legal advice on proposed strategies, and assess the range of outcomes based upon the legal and business considerations that apply.
  • Develop and implement focused litigation plans to further the efficient and ethical resolution of litigated matters.
  • Maintain case management status report and meet regularly with paralegals on assigned matters.
  • Manage a large volume of workload effectively and efficiently.
  • Meet minimum monthly billable hour requirements.
  • Regularly review and approve pre-bills for time input by attorneys or paralegals on assigned files.
Position Requirements
Education

J.D. from accredited law school

Bar Admission

Massachusetts Bar, member in good standing; admissioninthe Rhode Island and New Hampshire Bars preferred.

Experience

At least 3-5 year of practice – civil litigation/trial experience, with preference given to candidates that possess experience in the area of residential or commercial real estate, foreclosure, FDCPA, RESPA, and TILA claims, as well as creditor rights generally

Knowledge, skills, and abilities

Computer savvy and experience with the Microsoft Suite of programs, case management software; strong court room appearance; civil jury or non‑jury trial experience; keen attention to detail; organized; ability to multi‑task; possess strong work ethic and willingness to be part of a team.

Compensation Details

110k+; annually

The compensation amount is not guaranteed. Individual compensation is based on various factors unique to each candidate. This amount is what we reasonably believe we will pay for the position, however, offer amounts may vary based on factors such as geographic location, experience, and qualifications.

Benefits Details
  • Brock & Scott, PLLC offers an attractive benefit package to full‑time employees on the 1st of the following month of hire. The insurance portion includes medical, dental, voluntary life, voluntary vision, and critical illness, all at competitive rates. Atthe 90-day introductory period, the Firm also provides a basic life insurance policy in the amount of one time your annual salary (with a minimum of $25,000 and a maximum of $200,000.00) at no cost.
  • Full‑time attorneys receive paid holidays, including six (6) firm‑recognized holidays and one (1) Day of Observance, as well as a premium PTO package of 18 days per year. PTO accrues monthly and is credited on the 15th of each month, in accordance with firm policy. PTO benefits increase after 2 years of employment and again after 5 years of employment. After six months of service, employees over the age of 21 become eligible to participate in the firm's 401(k) plan at the beginning of the next quarter.
Pre-Employment Requirements

Employment with Brock & Scott, PLLC is contingent upon the successful completion of all required pre‑employment screenings and verifications, which may include, but are not limited to, a criminal background check, conflict of interest check, employment and education verification (as applicable), and a pre‑employment drug screening. Drug testing is conducted only after a conditional offer of employment has been extended and in accordance with applicable federal, state, and local laws.
