Field Prosecution Attorney – DUI Specialist

Job summary

South Carolina Department of Public Safety seeks field prosecutors to support magistrate court prosecutions, primarily DUI cases, embedded with Highway Patrol officers. You will provide timely legal advice in the field and assist in preparing and presenting cases.

You will handle appeals, training, and pre-trial matters under Title 56, with focus on confidentiality and professional conduct, reporting to the Assistant General Counsel.

Qualifications

• Juris Doctor degree or equivalent from an accredited law school.
• Five years of experience as a practicing attorney.
• Member in good standing of the South Carolina Bar.
• Completion of trial experience requirement under Rule 403, SCACR.
• Knowledge of general case, statutory and common law.
• Ability to communicate effectively, both orally and in writing.
• Must maintain confidentiality of all matters and work independently.
• Must have a valid SC Driver's License.

Responsibilities

• Provides legal advice to Department personnel on Title 56-related topics.
• Prepares responses to discovery requests in criminal matters.
• Handles appeals of Title 56 cases to circuit court.
• Conducts training and mentoring related to prosecution of Title 56 offenses.
• Handles pre-trial matters in Title 56 cases in summary court.
• Serves as Employee Advisor regarding investigations/disciplinary matters.
• Performs other duties as assigned by General Counsel and Assistant General Counsel.
