BCG Attorney Search seeks an experienced ERISA Class Action Attorney to develop and lead an expanding ERISA class action practice. The role focuses on sophisticated ERISA class actions from theory through trial, with emphasis on fiduciary duty matters in retirement and health benefits.

Candidates may come from plaintiff or defense sides. You will drive litigation strategy, collaborate with ERISA and employment attorneys across our national platform, and assume significant responsibility for case

Job Overview

A law firm is seeking an experienced ERISA Class Action Attorney to help develop and lead an expanding ERISA class action practice. The position involves handling sophisticated ERISA class actions from initial case theory through trial, with a particular focus on breach of fiduciary duty claims involving retirement and health benefits. Candidates may come from either plaintiff-side or defense-side practice. The attorney will have substantial responsibility for litigation strategy, case development, and the continued growth of the practice while collaborating with ERISA and employment attorneys across a national platform.

Duties

• Develop and litigate ERISA class actions from initial case theory through trial.
• Handle complex breach of fiduciary duty claims involving retirement plans, health benefits, and related ERISA matters.
• Investigate potential ERISA claims and evaluate legal theories for class action litigation.
• Develop and execute litigation strategies for complex ERISA matters.
• Draft and argue substantive motions and other litigation filings.
• Manage discovery, including document discovery and other complex class action discovery matters.
• Prepare for and participate in hearings, oral arguments, and courtroom proceedings.
• Manage cases through various stages of litigation, including trial preparation.
• Collaborate with ERISA and employment attorneys on complex matters.
• Provide substantive ERISA knowledge and strategic guidance to litigation teams.
• Assume significant responsibility for case strategy and litigation decisions.
• Contribute to the strategic development and growth of the ERISA class action practice.
• Work collaboratively with attorneys across multiple offices and markets.

Requirements

• Meaningful experience litigating ERISA class actions.
• Plaintiff-side or defense-side ERISA litigation experience will be considered.
• Extensive experience with ERISA breach of fiduciary duty litigation involving retirement and/or health benefits.
• Strong experience with motion practice and complex discovery.
• Courtroom and litigation experience.
• Ability to develop and manage sophisticated class action litigation strategies.
• Ability to work independently and exercise sound judgment over significant litigation matters.
• Strong interest in helping develop and grow an ERISA class action practice.
• Collaborative and self-directed approach to legal work.
• Active bar membership in good standing in the jurisdiction where the attorney is based.

Education and Certifications

• Juris Doctor (JD) from an ABA-accredited law school.
• Active bar membership in good standing in the applicable jurisdiction.
