Job summary

Penguin Solutions, the AI Factory Platform Company, seeks a Division General Counsel in a hybrid Durham, NC role to partner with the division on IP strategy, licensing, and risk management. The ideal candidate has deep patent law expertise and a track record of protecting and monetizing IP while guiding business decisions.

You will lead IP leadership, manage outside counsel, draft and negotiate commercial agreements, and advise executives on strategic initiatives, privacy, regulatory matters,

Qualifications

• J.D. from an accredited law school.
• Active membership in at least one U.S. state bar; USPTO patent bar preferred.
• 12+ years of legal experience with a focus on intellectual property law.

Responsibilities

• Lead IP strategy aligned with business objectives.
• Manage portfolio of patents, trademarks, copyrights, trade secrets and related assets.
• Oversee IP filings, registrations and protection initiatives.
• Advise leadership on IP creation, ownership, commercialization and competitive positioning.
• Lead IP litigation, enforcement strategies and settlements.
• Draft and negotiate commercial agreements, licenses, NDAs and partnerships.
• Manage outside counsel and legal budgets.
• Support governance, privacy, and regulatory risk management.
