Job summary

New York State Center for Recruitment & Public Service seeks a licensed attorney to preside over administrative proceedings involving incarcerated individuals at assigned correctional facilities. You will arrange witness testimony and documentary/video evidence and ensure due process, determining relevancy and admissibility of evidence with impartial conduct.

Evaluate evidence, resolve issues of law and fact, and prepare decisions with thorough explanations for dispositions, including sanctions

Qualifications

  • Law school graduation and admission to the New York State Bar or to the Bar of another state.
  • Three years of post-admission experience in adversarial proceedings including criminal law, arbitration, fact finding, dispute resolution, or other litigation practices.

Responsibilities

  • A licensed attorney who presides over administrative proceedings involving incarcerated individuals at assigned correctional facilities.
  • Arrange for witness testimony and documentary and video evidence.
  • Ensure that appropriate standards of due process are met, determine the relevancy and admissibility of evidence, and demonstrate impartiality throughout the hearing process.
  • Evaluate evidence presented, resolve issues of law and fact, and consider mitigating and aggravating circumstances.
  • Prepare decisions that include statements of the evidence relied upon and explanations for dispositions, including sanctions or programmatic referrals.
  • Electronically record all hearings conducted and develop a complete paper record for potential future litigation.
  • Maintain independence and regular contact with Counsel's Office supervisory staff.
  • Assist with FOIL appeal responses on behalf of the Department and other duties as assigned.
