Job summary

The New York State Center for Recruitment & Public Service seeks a licensed attorney to preside over administrative proceedings involving incarcerated individuals at assigned correctional facilities. You will arrange witness testimony and documentary/video evidence, ensuring due process and impartiality throughout the hearing process.

You will evaluate evidence, resolve issues of law and fact, and prepare decisions with thorough explanations for dispositions, including sanctions or referrals.

Qualifications

  • Law school graduation and admission to the NY State Bar or an equivalent state's bar.
  • Minimum three years of post-admission experience in adversarial proceedings.
  • Experience in criminal law, arbitration, or formal fact-finding is preferred.

Responsibilities

  • Preside over administrative proceedings involving incarcerated individuals.
  • Arrange witness testimony and documentary/video evidence.
  • Ensure due process and determine evidentiary relevancy/admissibility.
  • Evaluate evidence, resolve issues of law and fact, and consider mitigating and aggravating circumstances.
  • Prepare decisions with statements of the evidence relied upon and thorough explanations for dispositions.
  • Electronically record hearings and develop a complete paper record.
  • Maintain independence and regular contact with Counsel's Office supervisory staff.
  • Attend trainings, assist other hearing officers, and draft FOIL responses for the Department.
