Qualifications

  • Law school graduate required; NY Bar admission or admission to another state's Bar.
  • At least 3 years of post-admission experience in adversarial proceedings (criminal law, arbitration, formal fact finding, or related litigation).

Responsibilities

  • Preside over administrative proceedings involving incarcerated individuals at assigned correctional facilities.
  • Arrange for witness testimony and documentary and video evidence.
  • Ensure due process standards, assess relevancy and admissibility of evidence, and maintain impartial demeanor during hearings.
  • Evaluate evidence, resolve issues of law and fact, and consider mitigating and aggravating circumstances.
  • Prepare decisions with statements of evidence and explanations for dispositions, including sanctions or programmatic referrals.
  • Electronically record hearings and develop a complete paper record for potential litigation.
  • Maintain independence and regular contact with Counsel's Office supervisory staff.
  • Attend trainings, meetings, travel to assist other hearing officers, and draft FOIL appeal responses as needed.
