WV Offices of the Insurance Commissioner seeks an attorney to advise division directors on legal matters, prepare complaints and orders, and help regulate insurers, PBMs, bail bondsmen, PEOs, agents, TPAs, and other entities.

The role involves reviewing complaints, assisting senior attorneys, drafting memoranda, and potentially representing the Commissioner in various proceedings, including Administrative Proceedings and courts.

Qualificações

• Admission to the West Virginia State Bar is required.
• Two years of full-time or equivalent legal experience.
• Substitution: one year of attorney experience with the agency equals two years of experience.

Responsabilidades

• Consult with division directors and staff on legal issues, statutes, rules and case law.
• Prepare Administrative Complaints and Orders.
• Regulate insurance entities including companies, PBMs, bail bondsman, PEOs, agents, TPAs.
• Review first-party and third-party complaints.
• Assist higher level attorneys in legal matters including insurance premium tax disputes and market conduct proceedings.
• Review investigative files to recommend actions.
• Prepare legal memoranda and briefs.
• Respond to telephone inquiries and correspondence.
• May represent the Insurance Commissioner in Administrative Proceedings and courts.

The ideal candidate will be responsible for performing the following duties:

• Under general supervision, the successful candidate will consult with and advise division directors and staff on legal issues, statutes, rules and case law.
• Successful candidate will prepare Administrative Complaints and Orders.
• Will assist in the regulation of companies, PBMs, bail bondsman, PEOs, agents, TPAs, and other entities regulated by the Insurance Commissioner.
• Candidate will review and analyze first-party and third-party complaints.
• Will assist higher level attorneys in legal matters; including but not limited to insurance premium tax disputes, failures to timely act, market conduct proceedings, and financial examination reviews.
• Will review investigative files to recommend the appropriate course of action.
• Will prepare legal memoranda and briefs.
• Will respond to telephone inquiries and correspondence.
• May represent the Insurance Commissioner in Administrative Proceedings, Circuit Court, the Intermediate Court of Appeals, and the West Virginia Supreme Court.
• Other duties as required.

Training: Admission to the West Virginia State Bar.

Experience: Two years of full-time or equivalent part-time paid employment in the practice of law.

Substitution: One year of full-time or equivalent part-time paid employment as an attorney with the agency to which assigned shall be considered the equivalent of two years of experience.
