This position is located in the Office of Legal, Legislative, and Regulatory Affairs.
This Associate General Counsel position will be an integral part of the Market Regulation Team.
Counsel will assist the General Counsel and other attorneys on various transactional, operational, compliance, and regulatory legal matters primarily involving pharmacy benefit managers, pharmacy services administrative organizations, market analysis, market conduct, and other regulatory compliance matters.
Under the general supervision of the General Counsel, this position is responsible for advising and supporting the investigative and enforcement functions of the South Carolina Department of Insurance. This position handles enforcement cases originating in-house and referred by third parties. This position is expected to provide legal support to various business units involved in market regulatory matters and charged with enforcing the laws of the State of South Carolina.
Counsel will report directly to the General Counsel.
- Research and maintain current knowledge of applicable federal, state, local, and insurance laws related to pharmacy benefit managers and pharmacy services administrative organizations and market conduct standards; analyze how these might impact the relevant licensee and keep the General Counsel fully informed of relevant legal issues.
- Provides advice and counsel on investigation and enforcement matters related to PBM compliance; assists with the development of audits and examinations of PBMs and PSAOs; helps develop and maintain consistent enforcement procedures; manages, supervises, and monitors the status of examinations and the resolution of enforcement matters
- Help manage, coach, and supervise examiners and OGC regulatory staff assigned to the PBM Enforcement and Compliance Team; represents the South Carolina Department of Insurance in administrative and enforcement proceedings; manages related enforcement litigation to ensure issues are timely resolved; appeals adverse determinations and writes briefs and other legal memoranda as required.
- Organizes regular training sessions for members of the OGC and SCDOI staff on legal issues related to PBMs, PSAOs, and other market regulation activities
- Help oversee the conduct and management of examinations into regulatory and policy compliance matters involving licensees; monitor market analysis and examination processes; review examination warrants, market conduct and market analysis reports and other issues related to the market conduct function; assist with the development and conduct of market analysis training programs
- Assist with drafting contracts, legal memos, and other legal documents related to market regulation.
- Assist with reviews and edits of policies and other documents from applicable client departments to ensure that potential legal implications are appropriately addressed; recommend and help implement, with appropriate approvals, strategies, and initiatives to minimize the legal risks of current operations and proposed actions.

- have at least four (4) years of legal experience
- possess strong analytical skills, pay careful and particular attention to detail, and also have an investigative mindset
- have a deep and sound knowledge of regulatory policies as regulatory compliance staff are responsible for creating and implementing policies
- have computer skills and demonstrate proficiency in Excel, Word, PowerPoint, Westlaw and Outlook
- have excellent reading and language comprehension skills
- have excellent time management and organizational skills
- be extremely detail oriented and ability to spot errors and inconsistencies
- Demonstrates excellent communication (written and oral) skills (including proper grammar and usage)

- Demonstrated compliance experience within the financial industry.
- Demonstrated compliance experience in one of the following industries (healthcare, pharmaceutical, financial services or insurance, etc.)
