Job description

Job Summary:

Creditor's Rights law firm seeking an individual to fill the Associate Attorney position. Licensure is required with admission to the Nebraska Bar. Prefer additional licensing in Iowa. This position will be attending court, signing pleadings, settling cases, and various other attorney tasks as assigned. The ideal candidate will handle all aspects of litigation and should welcome the challenges of a dynamic legal environment and be open to work-related travel.

Must be energetic, self-directed, and capable of managing his or her own caseload. Responsibilities will include a wide variety of tasks associated with litigating debt collection matters. While litigation is the key role, we seek attorneys who can independently engage in risk analysis and develop strategies that adhere to state and federal rules and regulations, and compliance standards.

Essential Duties and Responsibilities:

  1. Review of correspondence, and files to determine whether they are appropriate, review of answers, preparation of discovery and dispositive motions, and all aspects of preparing for and conducting trials.
  2. Attend court hearings when required.
  3. Provide analysis and advice on legal and regulatory risks.
  4. An attorney should be familiar with state and federal consumer laws and keep abreast of any changes in state or local rules.
  5. Ability to effectively manage his or her own caseload.

Required Skills/Abilities:

  1. Maintaining a professional appearance and providing a positive company image to the public.
  2. Represent clients in pre-suit and post-judgment matters and attend court hearings when required.
  3. Excellent oral and written communication skills.
  4. Ability to prioritize and organize high volumes of information.
  5. Ability to work in a deadline-driven environment.
  6. Ability to interact effectively with people at all organizational levels of the firm.

Education and Experience:

  1. Background in civil litigation and experience attending court proceedings.
  2. Licensed to practice law in Nebraska. Prefer additional licensing in Iowa.
  3. Knowledge of federal, state, and local laws. Ability to analyze case law and provide recommendations.
  4. Ability to draft legal pleadings, motions, discovery, stipulations, etc. Also, to write, review, and edit reports, opinions, correspondence, articles, and other documents.
  5. Knowledge in Bankruptcy Law, Foreclosure Law or the FDCPA/FCRA/TCPA is a plus.
  6. Experience in collection law and/or significant courtroom experience is a plus.

Physical Requirements:

  1. Prolonged periods of sitting at a desk and working on a computer.
  2. Frequently required to talk or hear, and use hand to type, handle, or touch objects.
  3. Regularly required to stand and walk, and may be required to stoop, bend, or reach above the shoulders.
  4. Must be able to occasionally lift up to 25 pounds at times.
  5. Must be able to access and navigate each department at the organization’s facilities.

Work Environment:

The position is fully remote.

Schedule:

8am to 5pm Monday through Friday with flexibility to meet business needs.
