Job summary

West Virginia University is seeking an Assistant General Counsel to represent the University and WVURC on a broad range of legal matters, reporting to the Vice President and GC. The role involves policy drafting, contract negotiation, and advising on education, privacy, and compliance laws.

The successful candidate will have a JD from an accredited law school and at least one year of relevant experience, with WV licensure or willingness to obtain it.

Description

The General Counsel’s Office at West Virginia University is accepting applications for the position of Assistant General Counsel.

About the Opportunity

This position reports directly to the Vice President and General Counsel(“GC”) and will work at the will and pleasure of the GC. This position will be supervised day-to-day by the General Counsel.

The Assistant General Counsel will represent and advocate the legal interests of West Virginia University, the WVU Board of Governors, the President, West Virginia University Research Corporation(“WVURC”), and others on legal matters affecting the University by rendering a broad array of legal services as assigned, including, without limitation:

  • Provide direct policy-making input and advice on matters of substantial magnitude related to critical University activities, policy questions and operation procedures and, as needed, draft, modify, or review institutional policies, procedures, and practices.
  • Review, draft, and negotiate contracts on behalf of the University and WVURC.
  • Provide advice on issues related to the Family Educational Rights and Privacy Act (FERPA), the West Virginia Freedom of Information Act (WV FOIA), Family Medical Leave Act (FMLA), the Americans with Disabilities Act (ADA), and/or the Health Insurance Portability and Accountability Act (HIPAA).
  • Review, draft, and negotiate responses for documents requests, including WV FOIA requests, subpoenas, and other document requests.
  • Provide advice on issues related to higher education law, health care law, corporate law, employment, compliance with regulations governing federal research, immigration, trademark, and/or intellectual property.
  • Conduct legal research and draft memoranda.
  • Provide, under supervision of GC, high quality advice to the Board on legal matters affecting the University.
  • As directed from time to time by the General Counsel, assist in litigation relating to the University or affiliated entities.
  • All other duties as may be assigned from time to time by the GC.

Qualifications
  • J.D. degree from an accredited law school.
  • A minimum of one (1) year of experience in the following:
    • Experience in two or more of the following areas: higher education law, contract drafting, transactional work, litigation, health care law, corporate law, employment, compliance with regulations governing federal research, immigration, trademark, and intellectual property.
  • All qualifications must be met by the time of employment.

  • Excellent oral and written skills.
  • Strong legal research and writing skills.
  • Ability to work collegially in a diverse, complex environment.
Preferred Qualifications
  • At least 1-2 years of actively practicing law.
Requirements
  • Currently licensed to practice law in West Virginia or willing to become licensed in an agreed upon timeframe.
