Job description

The District Attorney is seeking an experienced attorney to coordinate and evaluate in-house People’s appeal and Article 78 requests and handle post-conviction litigation, including direct appeals, Article 440 motions, and federal writs of habeas corpus.

JOB RESPONSIBILITIES:
  1. Evaluate People’s appeal and Article 78 requests made through the Office internal request system.
  2. Make recommendations to the Appeals Bureau Chief on the viability of such appeals and communicate with other bureaus about requests.
  3. Draft People’s appeals and Article 78 briefs under the supervision of the Appeals Bureau Chief and other bureau managers.
  4. Assign and edit People’s appeals briefs and Article 78s.
  5. Maintain statistics and prepare reports on People’s appeals and Article 78s.
  6. Create a People’s appeals and Article 78s manual.
  7. Perform duties of a senior Appeals Bureau ADA, including:
  • Represent the People of New York in post-conviction litigation in state and federal courts.
  • Address complex legal issues clearly and persuasively in oral and written form.
  • Maintain a substantial post-conviction caseload.
QUALIFICATIONS:
  • Juris Doctorate degree, 5+ years of appellate prosecution experience, and 3+ years of People’s appeals experience.
  • US Citizenship and New York State Residency as of the first day of employment.
  • Superb writing, research, and analytical skills.
  • Excellent organizational and communication skills.
  • Excellent judgment and problem-solving skills.
  • Strong work ethic and ability to meet deadlines.
  • Passion for appellate litigation.

Residency Requirement

New York State Residency is REQUIRED on the first day of employment.
