Job description

Our FOIL and Civil Litigation Unit responds to Freedom of Information Law requests, civil subpoenas, inter-agency and in- and out-of-state law enforcement requests for records. The FCLU is the liaison with the New York City Law Department and coordinates representation of current and former ADAs for civil depositions related to State or Federal lawsuits.

Position Summary:

We are seeking an attorney with three or more years of experience to work in the FOIL and Civil Litigation Unit.

Responsibilities include but not limited to:

  • Assist in the day-to-day functioning of the FOIL and Civil Litigation Unit;
  • Respond to federal and state court subpoenas including the drafting of detailed privilege logs;
  • Respond to Article 78 petitions and appeals from Article 78 petitions related to the denial of records under the Freedom of Information Law;
  • Review FOIL determinations drafted by paralegals, review redactions to disclosable records, and draft and send out FOIL determinations in a timely manner;
  • Represent the Office at court appearances and/or oral arguments in response to civil subpoenas or in response to Art. 78 petitions related to FOIL requests;
  • Coordinate and assist the New York City Law Department in responding to discovery requests for civil suits alleging 1983 and Monell claims in state and/or federal court; and

Qualifications:

  • Have at least three years of experience as an attorney;
  • Have strong written and oral communication skills, the ability to multi-task, comply with short deadlines, handle a high volume of cases, and be detail oriented;
  • Exhibit an ability to maintain confidentiality of information;
  • Excellent inter-personal skills, the ability to work independently, and have strong organization and project management skills;
  • Civil litigation experience is not required, but beneficial.

Salary commensurate with experience. Salary range $97,000 to $134,000.
