Job summary

Responsibilities

  • Represent the County in state and federal litigation, including civil rights and defense work.
  • Advise County officials and employees on legal questions and draft opinions.
  • Gather facts, review investigations, and respond to correspondence.
  • Prepare and manage assigned cases for trial, including discovery and pleadings.
  • Present and argue cases in court and supervise related investigations.
  • Provide legal advice to various County divisions and interpret ordinances.

Job description

The Volusia County Attorney’s office is seeking applicants for one full-time position of Assistant County Attorney as part of our litigation team. This position will be responsible for professional legal work as a member of the County's legal staff representing divisions, advising administrative officials, and conducting civil suits. The applicant must be a member of the Florida Bar. No outside practice is permitted. The County is involved in a wide variety of state and federal litigation. Candidates must demonstrate excellent research and writing skills, and familiarity with state and federal rules of evidence and civil procedure.

  • Represent the County in various legal proceedings in state and federal court, ranging from liability defense, civil rights, workers’ compensation and defense of County actions.
  • Advises officials and employees on legal questions and prepares
    legal opinions.
  • Gathers facts, checks investigation reports, reviews files, and
    answers correspondence.
  • Participates in the preparation of assigned State and Federal cases for trial.
  • Conducts discovery, prepares briefs and pleadings, and supervises investigations.
  • Represents the County in trials and appeals.
  • Explains and interprets ordinances and case law.
  • Provides legal advice to various operating divisions.
  • Attends work on a regular and consistent basis.
  • Must adhere to Federal, State, County and Local ordinances.
  • Responds to emergency situations.
  • Performs related work as required.

Possession of a Juris Doctorate degree from an accredited law school and be an active member of the Florida Bar. No outside practice is permitted.

Must possess a valid driver’s Florida license at time of hire and maintain thereafter.

  • Knowledge of judicial procedures.
  • Knowledge of State statutory and State and Federal constitutional law, and their application to County operations and ordinances.
  • Ability to learn the organization, functions and authority of the various County departments.
  • Ability to present and argue cases in court.
  • Ability to analyze cases for their value as legal precedent.
  • Ability to deal tactfully and effectively with County administrative officials, employees, court officials, attorneys, and the general public.
  • Ability to work under stressful conditions.
  • Ability to interact effectively with others.
  • Ability to relocate to other county locations based upon operational needs.

Physical Demands:Sedentary work. Ability to see, hear, talk. Ability to lift, carry, push and/or pull 10 pounds.

Mental Demands: Ability to read and comprehend legal documents, statutes, ordinances; technical and professional journals and manuals, abstracts, and financial reports. Ability to write legal documents, business letters, summaries, opinions, etc. using prescribed formats. Ability to speak clearly and concisely relating information, details, and procedures to layman; persuasive/extemporaneous speaking; ability to speak in public. Ability to perform basic mathematical functions.
