Qualifications

TheOfficeofGeneral Counsel (OGC) is responsible for providing expert advice of counsel and legal representation to DCPS' Chancellor, CentralOffice, principals, and other school-based staff to help ensure that all DCPS students, regardless of background or circumstance, receive a world-class education that prepares them for success in college, career, and life. Major practice areas in OGCinclude:General Practice, which includes FOIA, FERPA, policy andethics, Laborand Employment, and Special Education due process litigation under the Individuals with Disabilities Education Improvement Act of 2004 (IDEA). Additionally, theofficeincludes the Labor Management and Employee Relations (LMER) team and the Compliance division.

Labor Management & Employee Relations (LMER)work group is responsible for supporting DCPS on a wide range of employee relations matters, including but not limited to: ensuring compliance with EEO laws;facilitating the proper implementation of progressive discipline; assisting employees with workplace problems; collaborating with unions to resolve issues and address concerns; working with managers to ensure compliance with all laws, regulations, and policies; scheduling meditations and hearings to address grievances; investigating allegations of misconduct by employees, contractors, and volunteers; and conducting background investigations to determine suitability for DCPS employment and service providers.

Compliance divisionis made up of the Internal Audit, Special Education Compliance, Risk Management, and Comprehensive Alternative Resolution and Equity (CARE) teams. The Compliance division works closely with various federal and District agencies, including but not limited to the Department of Education,Officeofthe Inspector General,Officeofthe District of Columbia Auditor,Officeofthe State Superintendent of Education,OfficeofHuman Rights,Officeofthe Chief FinancialOfficer, and Metropolitan Police Department on an as needed basis. The division receives concerns and complaints from students, parents, and third parties and provides effective andequitableresolution to issues raised, conducts internal audits of DCPS programs, and oversees the management of all audits of DCPS conducted by external entities. The division is also responsible foridentifyingandmitigating risks and workingand collaborating to ensure safety. The Compliance team’s mission is to work with all Schools and Central Services departments to ensure that operations and programming are compliant with applicable DCPS, District, and federal laws, regulations, and policies.

The Analyst, Investigations (Investigator) is responsible for conducting administrative investigations involving allegations of employee misconduct, policy violations, discrimination complaints and other matters that may implicate student safety, employee discipline, or organizational risk. The Investigator conducts fact-finding investigations involving DCPS employees, contractors, and volunteers, which may include matters with potential criminal implications.


The position requires independent judgment, discretion, and professionalism in handling sensitive and confidential information, while ensuring investigations are conducted in compliance with DCPS policies, collective bargaining agreements, District regulations, EEO, and applicable federal and local laws.

This position has been designated as Security Sensitive. Pursuant to section 410 of Chapter 4 of the D.C. Personnel Regulations; in addition to the general suitability screening, individuals applying for or occupying security sensitive positions are subject to the following checks and tests: Criminal background check; Sex Offender Registry check; Traffic record check (as applicable); Consumer credit check (as applicable); Reasonable suspicion drug and alcohol test; and Post-accident or incident drug and alcohol test.

Essential Duties and Responsibilities

The below statements are intended to describe the general nature and scope of work being performed by this position. This is not a complete listing of all responsibilities, duties, and/or skills required. Other duties may be assigned.

Principally, the Analyst, Investigations (Investigator) will perform the following duties and responsibilities:

  • Conducts administrative investigations by interviewing complainants, witnesses, and subjects to obtain statements related to alleged employee misconduct, hostile work environment, and discrimination complaints involving DCPS employees, contractors, and volunteers.
  • Plans and executes investigations independently, including identifying investigative steps, witnesses, and relevant evidence.
  • Collects, evaluates, and analyzes statements, documentary evidence, electronic records, and camera footage todetermine whether allegations are substantiated, unsubstantiated, or inconclusive.
  • Assess credibility and resolves conflicting accounts.
  • Prepares clear, thorough, and legally sufficient investigative reports for use in employee disciplinary actions, hearings,and suitability determinations.
  • Maintains accurate, timely, and confidential case files and interview notes in accordance with DCPS record-retention requirements.
  • Ensures appropriate documentation, evidence preservation, and chain-of-custody practices where applicable.
  • Drafts investigative summaries, memoranda, and briefings for DCPS leadership, Human Resources, Labor Relations, andthe Office of the General Counsel.
  • Applies and interprets DCPS policies, District regulations, EEO laws, collective bargaining agreements, and applicable federal andlocal laws.
  • Identifies matters requiring mandatory reporting, external referrals, or coordination with law enforcement or oversightagencies.
  • Liaises with local, state, and federal law enforcement agencies during administrative investigations with potential criminal implications.
  • Works collaboratively with school administrators, Central Services staff, Human Resources, Labor Relations, and the Office of the General Counsel.
  • Provides guidance and technical assistance to school-based and Central Services staff regarding investigative processes and reporting requirements.
  • Testifies in administrative hearings, grievance proceedings, and court proceedings when applicable.
  • Liaises with external agencies including OHR, EEOC, and other entities to coordinate and support EEO complaints and inquiries.
  • Maintains professional relationships with school personnel and community partners throughout the investigative process.
Qualifications
  • Bachelor's degree and one year of experience OR two years of experience (no degree requirement).
  • Previous exposure to or experience in the education sector a plus.
  • Previous exposure to or experience with discrimination complaints and EEO laws a plus.
  • Ability to communicate effectively orally and in writing and to pay attention to detail within a fast-paced environment.
  • Ability to develop, plan, and implement short and long-range goals.
  • Must be attentive to detail, extremely well organized, able to work under pressure, and able to meet frequent and changing deadlines.
