Description

The Office of General Counsel, part of the Massachusetts Department of Public Health (DPH) is seeking a dynamic Administrative Magistrate who thrives in applying legal expertise in a judicial capacity while maintaining the independence essential to fair and impartial decision-making. This role is integral to adjudicating administrative proceedings for the Bureau of Health Professions Licensure, ensuring due process and professionalism in all matters. From conducting pre-hearing conferences to issuing written decisions and overseeing hearings, this position requires a strong legal mind, keen analytical skills, and a commitment to upholding the integrity of the administrative process.

This role is ideal for an attorney who thrives in a structured yet dynamic environment where case management, legal analysis, and judicial discretion are key. With the responsibility of prioritizing caseloads, maintaining accurate records, and safeguarding confidential information, the Administrative Magistrate plays a crucial role in the efficient resolution of regulatory matters. Duties and Responsibilities (these duties are a general summary and not all inclusive)
  • Perform judicial functions in adjudicatory proceedings under M.G.L. c. 30A and 801 CMR 1.01 with fairness, impartiality, and professionalism.
  • Conduct pre-hearing conferences, issue procedural orders, and rule on motions to ensure efficient case management.
  • Preside over administrative hearings, evaluate evidence, and maintain order in proceedings.
  • Prepare and issue written tentative decisions following hearings, ensuring clarity and legal accuracy.
  • Manage and prioritize caseloads to facilitate the timely resolution of matters.
  • Maintain accurate case dockets, records, and documentation in compliance with legal and procedural requirements.
  • Safeguard confidential and sensitive information in accordance with applicable laws and policies.
  • Uphold the integrity of the administrative process by adhering to legal and ethical standards.
Required Qualifications
  • Comprehensive knowledge of legal theory, principles, and practices, including administrative and courtroom procedures.
  • Strong ability to interpret legal documents and apply relevant laws, rules, and regulations governing agency operations.
  • Skilled in managing multiple projects and balancing competing priorities effectively.
  • Proficiency in using computers for legal research, database management, document preparation, and conducting virtual hearings where appropriate.
  • Strong organizational skills to manage case files, legal documents, and information efficiently.
  • Ability to exercise discretion and safeguard confidential information in compliance with disclosure regulations.
  • Effective verbal and written communication skills to articulate legal arguments clearly and concisely.
  • Proven ability to interact professionally and effectively with diverse groups of people.
Preferred Qualifications
  • Thorough knowledge of the laws governing professional licensure, discipline, and the conduct of adjudicatory hearings.
  • Ability to draft documents related to board disciplinary actions, including rulings and tentative decisions.

Qualifications

MINIMUM ENTRANCE REQUIREMENTS: Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and (A) at least three years of full-time, or equivalent part-time, professional experience in the practice of law.

Incumbents may be required to have a current and valid Motor Vehicle Drivers License at a Class level specific to assignment.

Salary placement is determined by a combination of factors, including the candidate’s years of directly related experience and education, and alignment with our internal compensation structure as set forth by the Human Resources Division’s Hiring Guidelines. For all bargaining unit positions (non-management), compensation is subject to the salary provisions outlined in the applicable collective bargaining agreement and will apply to placement within the appropriate salary range.
