Responsibilities

  • Provide senior contractual and commercial support across multiple civil, building, rolling stock, railway systems and trackwork packages.
  • Liaise with the Employer's Project Management Organisation.
  • Prepare and review contractual correspondence.
  • Provide contractual input into monthly and quarterly progress reports.
  • Monitor incoming and outgoing correspondence, change registers and claims logs.
  • Ensuring compliance with the Engineer's contractual response obligations.
  • Assessing contractors' extension-of-time and cost claims.
  • Preparing contractual recommendations and formal determinations.
  • Advising on contractors' interface obligations.
  • Preparing Variation Orders and Contract Amendments.
  • Supporting the preparation of Interim Payment Certificates.
  • Managing Employer Taking-Over activities.
  • Preparing Taking-Over Certificates.
  • Coordinating with contracts, technical, cost and programme teams.
  • Support during Dispute Board proceedings, including reviewing position papers and attending hearings.

Rail Contract Manager - Philippines

EWI is supporting an international engineering consultancy consortium in the recruitment of an experienced Contract Manager for the landmark North-South Commuter Railway Project in the Philippines.

The consortium is acting as the General Consultant and FIDIC Engineer to the Department of Transportation Railways, on behalf of Philippine National Railways. The project is financed by JICA

This is an excellent opportunity for a senior contracts professional to take a key role on one of Southeast Asia's most significant railway infrastructure programmes.

The Role

The successful candidate will provide senior contractual and commercial support across multiple civil, building, rolling stock, railway systems and trackwork packages.

Working alongside the existing contracts, commercial, cost, schedule and technical teams, your responsibilities will include:

  • Supporting the contractual and commercial administration of major construction, rolling stock and railway systems packages
  • Liaising with the Employer's Project Management Organisation
  • Preparing and reviewing contractual correspondence
  • Providing contractual input into monthly and quarterly progress reports
  • Monitoring incoming and outgoing correspondence, change registers and claims logs
  • Ensuring compliance with the Engineer's contractual response obligations
  • Assessing contractors' extension-of-time and cost claims
  • Preparing contractual recommendations and formal determinations
  • Advising on contractors' interface obligations
  • Preparing Variation Orders and Contract Amendments

The role will also provide support during Dispute Board proceedings, including reviewing contractors' position papers and referrals, preparing Employer position papers and rejoinders, attending hearings, and assisting with post-hearing statements.

Required Qualifications and Experience

Candidates should demonstrate:

  • A bachelor's degree in a relevant discipline
  • At least 20 years of professional experience in longitudinal infrastructure
  • A minimum of 10 years of railway project experience
  • A strong commercial, contractual and/or legal background
  • Previous experience as a senior construction contracts specialist
  • Native-level or expert business English
Essential FIDIC Expertise

Applicants must possess substantial practical knowledge of international construction contracts, particularly:

  • FIDIC Pink Book, Multilateral Development Bank Harmonised Edition, June 2010
  • FIDIC Yellow Book and JICA Standard General Conditions
  • Re-measurement contracts, Bills of Quantities and cost-adjustment mechanisms
  • Lump-sum contracts and schedules of payment
  • Particular Conditions, Contract Data and Special Provisions
  • Contract-document hierarchy and order of precedence
  • Contractor compliance and entitlement assessment
  • Contract Amendments
  • Variations and Adjustments under Clause 13
  • Contract Price and Payment under Clause 14
  • Claims, Disputes and Arbitration under Clause 20
  • Assessment of time and cost claims
  • Dispute Board procedures, referrals and informal opinions
Desirable Experience

The following would be advantageous:

  • Knowledge of the FIDIC Golden Principles
  • Completion of recognised FIDIC training programmes, seminars or workshops
  • Previous experience on JICA or ADB-funded Official Development Assistance projects
  • Experience working in Asia or Southeast Asia
  • Understanding of the interaction between local laws and FIDIC contract provisions
  • Membership of a relevant professional institution
Package

Salary is likely to be $9-12,000 per month Tax free with additional $3,000 for allowances Tax Free
