Wills and Estates Lawyer for mid size full service law firm client, North York.

Job Type : Permanent Full-Time.

Compensation : From $100,000 to $150,000 per annum according to experience, plus comprehensive benefits.

Additional Benefits : Advancement opportunities, flexible hours, excellent technical, administrative and peer supports and resources.

Standard Work Hours : 7.0 hours per day not including lunch break, to be worked during regular business hours, Monday to Friday.

Work Location : Hybrid - combination of 2 days remote-based and 3 days onsite at client's North York office, with free parking provided. Onsite work expectations subject always to client business requirements, and may change according to client business need.

Position Reports To : Partner.

Responsibilities Summary :

As part of a dynamic, growing team, you will maintain and develop a diverse client base, working closely with clients to develop personalized strategies that align with their wishes for their estate, to manage a wide range of estate planning and administration matters, and to provide comprehensive legal advice on estate planning, including wills, trusts, and powers of attorney.

  • Meet with clients to understand their desired asset distribution, health care decisions, and overall estate plan. Provide clear and concise legal advice on options and implications.
  • Conduct thorough legal research to stay current on relevant laws and regulations related to estate planning and probate. Draft and review a range of estate planning documents tailored to individual and family needs.
  • Collaborate with financial advisors, tax professionals, and family members to develop comprehensive estate plans and develop tax-efficient estate strategies.
  • Assist clients to identify and designate beneficiaries.
  • Assist clients to create and manage trusts, including revocable living trusts and irrevocable trusts.
  • Oversee estate administration, including applications for probate. Assist clients, executors or administrators to navigate the probate court process.
  • Advise executors, beneficiaries, and trustees on legal responsibilities and obligations. Ensure all legal, deadlines and record keeping requirements are met during the estate administration process.
  • Assist with estate management, including collecting insurance proceeds, paying debts and taxes, and distributing remaining assets.
  • Maintain compliance with Law Society of Ontario rules and best practices for client management and file handling.
  • Additional client management, advisory and executional responsibilities as required.

Qualifications :

Education : LLB or JD from a recognized law school.

Professional Credentials : Member in good standing with the Law Society of Ontario.

Preferred Work Experience : At least 3+ years of experience in estate planning and trust arrangements, including a portable book of business.

Sector Experience : Law Firm experience required.

Technical and Language Skills Requirements :

  • Proficiency with legal case management, legal billings, legal research, and legal documents management applications.
  • Proficiency with MS Office applications.
  • Advanced English communication skills, both written and verbal.
  • Verbal fluency in additional language(s) an asset.

Task -Based Qualifications and Additional Attributes :

  • Strong professional and academic credentials.
  • Sound understanding of Ontario’s Succession Law Reform Act, Estates Act, Trustee Act, and relevant procedural rules.
  • Excellent communication and networking skills. Demonstrated negotiation, change management and consulting / advisory skills.
  • Demonstrated record of professional conduct and character. Responsible, reliable and works to deadlines. Demonstrated ability to work well both independently and collaboratively, and in an advisory capacity.
  • Proven ability to respond to sensitive and confidential matters with tact, discretion, and excellent judgement. High degree of empathy to work with clients in emotionally difficult circumstances.
  • Demonstrated successful experience of prioritizing work, making decisions and communicating with others within a values framework of respect, equity, anti-racism, diversity and inclusivity.

Additional Requirements :

  • Must be legally entitled to work in Canada, providing satisfactory documentation upon request.
  • Ability to work both remotely and onsite, abiding by organization health and safety policies.
  • Ability to declare personal Non-Conflict of Interest in execution of position responsibilities.
  • Satisfactory Background Checks and Employment References.
