The Investigator - Unlicensed Practice is responsible for responding to and investigating allegations of violation of the practice protection and title protection provisions of the Professional Engineers Act (PEA). The role involves ensuring compliance by individuals and/or companies with the Act, or pursuing prosecution when necessary.
Responsibilities :
- Respond to inquiries from the public, professional engineers, and applicants.
- Contact unlicensed persons and unauthorized companies to obtain compliance with the PEA.
- Prepare and send demand or cease-and-desist letters to non-compliant individuals and companies.
- Gather evidence from informants, witnesses, and building departments.
- Negotiate solutions and written agreements with respondents to achieve compliance.
- Prepare investigative briefs and submit evidence and reports in a timely manner.
- Manage enforcement cases in court, including laying charges under provincial offences.
- Collaborate with legal counsel during prosecutions, including gathering evidence and court appearances.
- Advise on compliant workplace titles.
- Testify in court proceedings and serve legal documents as an agent of PEO.
- Maintain relationships with law enforcement and government agencies for joint investigations.
- Identify urgent or high-profile issues and notify management.
- Deliver enforcement-related presentations as assigned.
- Manage investigations from start to finish, including interviewing and report writing.
- Conduct ongoing research on case law and investigative best practices.
- Liaise with managers and legal counsel as needed.
Specialized Skills & Knowledge :
- Knowledge of the Professional Engineers Act, Ontario regulations, and enforcement policies.
- Proficiency with computer databases, Microsoft Office, and investigative tools.
- Understanding of legal methods, case law, and court procedures.
- Experience in laying charges and prosecuting under provincial legislation.

Qualifications :
- Paralegal diploma or equivalent, with post-secondary education in law, criminology, or related fields.
- 3-5+ years of experience in compliance or investigations, preferably in legal or regulatory settings.
- Knowledge of court processes and investigative methods; certification in investigative techniques is an asset.
- Proven experience in evidence gathering, legal briefs, and prosecutions.
- Driver's license in good standing ('G' class preferred).
We offer a hybrid work environment, requiring presence in the office twice a week, with flexibility for more office days. This is a minimum 12-month contract.
