Associate Manager – Corporate Contracts | Emirates Global Aluminium (EGA) Abu Dhabi

To manage the activities of a centralized Corporate Contracts for EGA and its subsidiaries. The purpose of this job also includes being responsible for contract strategy and its associated activities specifically the tendering, awarding, management and close-out of Corporate Contracts in accordance with agreed business objectives. Job holder is responsible to handle contracts / procurement spends for value above USD 150 million.

KEY ACCOUNTABILITIES:

Policies, Processes and Procedures

Implements approved departmental policies, processes, procedures and provides instructions to subordinates and monitor their adherence so that work is carried out in a compliant and controlled manner.

Leadership

Manages activities of Corporate Contracts to ensure smooth operation of respective area of responsibility with a high level of service in terms of procurement of materials and services on time to the correct specification and at optimum cost.

Leads and responsible for the smooth functioning of Corporate Contracts, assists in the development of his direct reports, manages second-in-command and delegates duties to as appropriate, maintains oversight of budgets and major projects, provides departmental reports to superior according to the published schedule, or as required.

Manages team members in close coordination with users and finance department to ensure that all commercial logistics aspects are properly maintained.

Performs development of specific goals, evaluating staff performance, establishing work priorities and co-ordinating schedules, maintain personnel records and training staff.

Day-to-day operations

Develops, implements, and manages tender and contracts strategies in order to meet EGA’s needs based on EGA tendering procedures with a close focus on price, risk, certainty and value delivery.

Sustains the operation of one-stop center of expertise responsible for all tendering activities, manages contract resolution claims to ensure effective and timely solutions thereby assisting various areas to focus on their own functional activities.

Devises and implements tendering strategies which ensure that EGA obtains access to qualified service providers and receives tenders which are comprehensive, clear, easy to evaluate and cost-effective.

Provides informative reports and recommendations for consideration and approval ensuring that the award of contracts is carried out fairly, ethically, and rigorously with due consideration of all available facts.

Re-engineers existing tender and award processes to eliminate activities which do not add value, and to reduce the time taken for tender and award so that the company projects could proceed quickly.

Devises, implements, and maintains rigorous administrative systems to enable stakeholders to track project progress and to facilitate auditing, whilst maintaining an appropriate level of confidentiality.

Manages contractual issues from award to close-out, including warranties and settlement of claims, to ensure that financial contract obligations are fulfilled by all.

Liaises with other departments, regarding forecast, resourcing and services as necessary and provide guidance to areas on appropriate contracting strategies.

Communicates with people outside the organization, representing the organization to customers, the public, and other external sources.

Ensures that tendering, contract award and contract management processes are implemented and delivered for all Corporate Contracts in line with EGA guidelines to meet the objectives of EGA.

Approves Purchase Orders / Contracts as per Level of Authority mentioned in EGA Delegation of Authority (“DOA”).

Tendering

Maintains a high standard of efficiency, professionalism, and ethics in the supervision of competitive bidding and proposal process.

Checks and reviews commercial/contractual deviations taken by bidders consult with legal advisor/assistant when necessary and drafts acceptable/alternative condition/solutions for the final disposition of all Corporate Contracts.

Shortlists preferred suppliers according to EGA’s requirements in terms of quality, price and specifications, and provides recommendations to area managers on the suitable supplier/s, in order to ensure selection of the most appropriate supplier/s in compliance with EGA’s procurement policies and procedures.

Manages and Supervises tender issuance to various vendors for submission of tenders in order to meet business requirements.

Liaises with end-users / originators for any inquiry regarding tenders and follows up on technical evaluation status.

Monitors tender clarification and Addendum issuance and also tender receipts and coordinates the tender openings by Procurement Tender Committee (“PTC”) and Executive Tender Committee (“ETC”).

Bidder Clarification Meetings

Participates in technical / commercial clarification meetings to obtain technical / commercial clarification from bidders to ensure sound and informed award decisions are made by EGA.

Contract Development

Develops tender enquire package comprising technical, commercial and legal documents that are consistent, concise and comprehensive in accordance with the purchasing procedures.

Ensures required approvals are obtained from all parties prior to EGA awarding a contract to ensure proper governance of Contracts policies and procedures.

Contract Issuance

Supports the direct report in preparing the contracts in line with the defined scope of work and specifications in order to protect EGA’s interests and ensures that contractors adhere to the specified terms and conditions, timelines and quality standards.

Coordinates with the Legal and Compliance function on any variations to contract terms and conditions or clauses to ensure EGA’s interests are protected.

Reviews and updates standard templates and formats on contract issuance and submits to the next levels with recommendations for approval.

Manages his direct reports in obtaining contract approvals, contract issuance to contractors and receipt from contractors.

Negotiations

Participates with his direct reports for negotiation of the final technical and commercial terms with tenderers to ensure EGA receives best value.

Supports his immediate superior in negotiations of contract disputes with suppliers/vendors in order to agree on a mutually satisfactory resolution and out-of-court settlement.

Records Management

Maintains accurate and complete purchasing records as required by purchasing procedures, administrative regulations, internal, external and government auditors.

Safety, Quality and Environment

Ensures the implementation of safety, quality and environment standards in procurement process in line with EGA and / or its subsidiaries management vision.

Complies with EHS policies, procedures and controls to ensure a healthy and safe work environment.

Market Analysis

Communicates with people outside the organization, representing the organization to customers, the public and other external sources.

Related Assignments

Coordinate with Area and Quantity Surveyor for timely release of contractor’s payment for all Corporate Contracts.

AUTHORITY/ DECISION MAKING

Works within the set guidelines, policies and procedures and independently make decisions.

Works independently and involves the immediate superior (as per the EGA DOA) to authorise pricing over and above limit and to intervene if a problem arises. His direct reports works independently but only approach the job holder for overall guidance and consultation and to intervene in interdepartmental issues.

Updates immediate superior frequently on matters involving administrative problems or seeks guidance on major issues, reviews plan of action or discusses recommendations for improvement of existing processes, policies, procedures and budgets.

QUALIFICATIONS AND SKILLS:

Minimum Qualifications

Bachelor’s degree, preferably with specialization Engineering, or Project Management discipline, or in Supply Chain / Material Management, or any related specialization.

Diploma or Certification in Procurement and Contracts is preferred.

Minimum Experience

6 years relevant experience in contract management and contract administration in a similar industry.

Skills

Good knowledge of the aluminum smelting industry.

Strong knowledge of standard contract terms of conditions, etc.

Good negotiation and interpersonal skills.

Excellent written and communication skills.
