RESPONSIBILITIES
- Review of contracts, cooperation agreements, term sheets, partnership agreements (consortiums, JVs), exclusivity agreements, MOUs, and NDAs from the clients and partners.
- Provide summaries on major provisions in the contracts.
- Identify risks and opportunities in contracts & agreements.
- Mitigate contractual risks by drafting corresponding qualifications.
- Negotiate and conclude qualifications and deviations with the clients and stakeholders.
- Lead the teams on contractual matters, preparation, reviewing, and resolution of claims and disputes.
- Liaise with the legal department to obtain legal opinions, reviews, power of attorneys, parent company guarantees, code of conduct, and other corporate legal documents.
- Liaise with the finance department on finalizing contracts’ structures, letters of credit, bank guarantees, parent company guarantees, etc.
- Liaise with the insurance department on establishing and maintaining insurance policies in accordance with the respective contracts.
- Assist the legal department with the ongoing cases.
- Familiar with BOQ, Market rates, Labor, plants, and machinery rates.
- Should be able to read Drawings and understand the specification.
- Quantifies the financial impact of a dispute or claim
- Hands-on skills in using the latest MS Office (Word, Excel & PowerPoint) and Adobe Acrobat.
- Hands-on experience in working with direct and indirect costs associated with Prolongation, Disruption and Acceleration claims.)
- Hands-on experience in drafting the overall claims report.
- Understands the various techniques in delay analysis and should be able to understand EOT analysis.
- Hands-on experience in presenting Claims to the Employer.
- Expert in building Rebuttals & Counter Claim.
INDUSTRY : Preferably from Multinational & Renowned EPC Contractors, Consultancies, and Law Firms.
YEARS OF EXPERIENCE : 13 - 18 years
EDUCATIONAL QUALIFICATIONS : Bachelor’s degree in law, quantity surveying, or Engineering. A master’s degree in construction law is beneficial.
