Job Summary:

We are seeking a highly skilled and solution-driven Tax Attorney to provide legal representation, contract drafting, and strategic tax advisory to clients dealing with SARS disputes, tax planning, and commercial transactions. The ideal candidate will have a strong grounding in South African tax law, experience engaging with SARS, and proven competence in drafting and reviewing tax-sensitive legal agreements for individuals, SMEs, and corporate clients.

Key Responsibilities:

Tax Dispute Resolution & Legal Representation:

  • Represent clients in SARS-related disputes including objections, appeals, and Alternative Dispute Resolution (ADR)
  • Draft legal opinions, dispute letters, and court documents in line with the Tax Administration Act and relevant case law
  • Appear before the Tax Board or Tax Court when necessary and engage SARS Legal & Technical divisions effectively

Contract Drafting & Legal Documentation:

  • Draft, review, and negotiate contracts with tax implications, such as shareholder agreements, sale of business agreements, loan agreements, and commercial leases
  • Ensure legal agreements align with tax strategy, minimise risk, and comply with the Income Tax Act, VAT Act, and SARS regulations
  • Provide guidance on structuring agreements to support tax efficiency in business operations and transactions

Advisory & Compliance:

  • Provide legal tax opinions across all tax types (Income Tax, VAT, CGT, PAYE, etc.)
  • Assist clients with voluntary disclosure programme (VDP) applications and tax compromise negotiations
  • Advise on local and cross-border tax structures, trusts, and estate planning from a legal-tax perspective

Client Engagement & Strategy:

  • Develop legal tax strategies tailored to the client’s commercial and financial goals
  • Collaborate with tax practitioners, accountants, and auditors to ensure cohesive and compliant tax solutions
  • Interpret legislation, SARS rulings, and court precedents to resolve complex client matters

Knowledge Management & Development:

  • Monitor legal developments, SARS practice changes, and court rulings relevant to tax law and contracts
  • Contribute to internal knowledge sharing, training, and legal bulletins

Minimum Requirements:

  • LLB Degree (essential); Postgraduate Diploma in Tax Law or LLM in Tax (preferred)
  • Admitted Attorney of the High Court of South Africa
  • 2+ years post-admission experience in tax law, contract drafting, or related legal practice
  • Strong drafting and legal research skills with attention to legal-tax implications in contracts
  • In-depth understanding of the Tax Administration Act, Income Tax Act, VAT Act, and SARS dispute resolution process
  • Proficiency with SARS eFiling, Microsoft Office, and legal research platforms (e.g., LexisNexis)
