Requirements :
- An LLB degree. For serving prosecutors seeking promotion, any appropriate legal qualification.
- Right of appearance as contemplated in section 25(2) of the NPA Act, 32 of 1998.
- At least five (5) years’ post-qualification legal experience.
- At least five (5) years of relevant criminal court work experience in advocacy and drafting.
- Demonstrable competency in acting independently, professionally, responsibly, and with credibility.
Duties :
- Study case dockets, assess them, and decide on the institution of prosecution. Handle representations and guide investigations in complex or difficult tax and commercial matters.
- Prepare cases for court, including gathering additional evidence and drafting charge sheets, indictments, and court documents.
- Present the State’s case in court, lead and cross-examine witnesses, and address the court regarding conviction and sentencing. Manage court and case flow independently. Handle appeals and reviews.
- Prepare legal opinions and arguments for complex cases and argue cases in court. Appear in motion proceedings related to criminal matters and conduct prosecutions on behalf of the state. Mentor investigating officers, prosecutors, and stakeholders.
- Assist in high-profile cases or those with increased risk. Promote partnership, community involvement, and customer satisfaction within the criminal justice system, independently managing court and case flow.
