Job description

We are currently hiring a Senior Legal Advisor: Litigation to join the Legal Services team.

The key purpose of this role is to provide sound legal support to post-investment monitoring of investments where there are emerging defaults on loan servicing and active involvement in deal restructuring.

Additionally, the role involves understanding and analyzing the commercial aspects of transactions and providing expert legal solutions.

Key Responsibilities:

  1. Provide sound legal support to post-investment monitoring of investments with emerging defaults on loan servicing.
  2. Actively participate in deal restructuring.
  3. Provide prompt and sound legal advice and support to the NEF, particularly the Post Investment Department & Turnarounds, Workouts, and Restructuring department.
  4. Provide legal input to submissions on existing investments prepared for the Portfolio Management Committee and other relevant committees.
  5. Implement committee decisions to recover funds, ensuring the rights of NEF are protected.
  6. Negotiate settlements and brief external attorneys.
  7. Implement and monitor debt recovery, litigation, liquidation, and all other legal and court processes, whether outsourced to external law firms.
  8. Manage the restructuring of companies, draft and review all legal agreements related to this process.
  9. Address all legal matters relating to the NEF and its investee companies.
  10. Implement amendments to funding structures and terms and negotiate contracts with investee companies or third parties.
  11. Provide general legal advice to the NEF's various departments.

Qualifications:

LLB, Admitted Attorney

Experience / Skills Required:

  1. At least 5 years' post-articles experience in a similar environment.
  2. At least 5 years of litigation, business rescue, and court experience.
  3. Experience in securities law and/or insolvency law and/or general experience in commercial law.
  4. Proven working knowledge of Company law, Tax law, and NCR.
  5. Business report writing and MS Office suite knowledge.
  6. Experience in Turnarounds, Workouts, and Restructuring is advantageous.
