Job description

Purpose of the Job : The RAF Attorney : High Court is responsible for all High Court matters within the Fund and to offer litigation services accordingly. This role will also be responsible for performing a range of tax services, including tax bills of costs, in compliance with South African laws and regulations.

Key Performance Areas

Policy Review and Implementation

  • Contribute to the development and implementation of departmental policies, procedures, and processes.
  • Keep up to date with effective policy and practice execution strategies.

Preparation and Research on Related Litigation Matters

  • Conduct research to provide information in preparation for all trial matters.
  • Consult with client departments, representatives, and witnesses for instructions and documentation for court cases.
  • Draft pleadings to clearly motivate or justify a particular position in the case.

Mediation Process

  • Follow all steps regarding the mediation process as governed by amendments to the rules of court.
  • Notify the Registrar and other parties upon completion of mediation.
  • Parties and mediators must issue a joint minute within 5 days of mediation completion.

Represent the Road Accident Fund in all third-party claims related litigation matters

  • Attend court appearances in all allocated third-party litigation matters.
  • Ensure file administration from opening to case conclusion, including adherence to trial dates.
  • Handle appearances at courts, tribunals, mediation hearings, and inquiries.
  • Coordinate legal actions to ensure compliance.
  • Approve instructions for appointing and instructing expert witnesses.

Settle non-litigious matters before they are scheduled for trial

  • Assess files early, and instruct experts and assessors promptly.
  • Approve requests for appointing assessors and expert witnesses.
  • Recommend settlements.

Provision of legal advice to RAF

  • Provide legal advice on legal matters and contracts.
  • Conduct legal research and prepare legal opinions.

Taxation

  • Deliver a full range of tax services compliant with laws and regulations.
  • Build relationships with clients to provide tax consulting and expertise.
  • Review complex income tax returns and provide innovative tax planning.

Reporting

  • Prepare and submit regulation reports and updates for management decisions.
  • Develop reports, policies, and procedures aligned with RAF’s strategy.
  • Create reporting systems for management and performance analysis.
  • Prepare proposals, briefings, presentations, and reports for management.

Stakeholder Management

  • Manage communication with internal and external stakeholders regarding investments.
  • Manage relationships with vendors and service providers, ensuring timely invoicing and payments.
  • Engage with stakeholders at all levels.

People Management

  • Source, develop, and retain a high-performance team.
  • Manage recruitment and staff objectives aligned with RAF’s strategic goals.
  • Implement HR processes to manage workplace conflict and deviations from standards.
  • Motivate and evaluate team members to achieve their goals.

Qualifications

  • Bachelor’s Degree in Law or equivalent.
  • Postgraduate qualification in Law or equivalent.
  • Admission as an Attorney of the High Court or Advocate.
  • Right of appearance in the High Court.

Experience

  • 5-7 years of legal experience post-graduation or admission, with at least 2 years in personal injury litigation.
