Purpose of the Job

Reporting to the Senior Manager: Litigation and Mediation, the successful incumbent is accountable for managing and reporting on operational litigation involving issues of constitutionality.

The incumbent will support the Senior Manager on all litigation-related matters aligned with the strategic objectives of the organisation as determined by the Board.

Key Performance Areas

Litigation Management

  • Manage the implementation of the overall litigation strategy.
  • Institute and defend litigation actions for and against the RAF.
  • Manage and monitor the litigation risk of the RAF.
  • Oversee referred claims litigation to determine settlement or court proceedings.
  • Manage high court and magistrate court attorneys and other legal service providers supporting the litigation unit.
  • Ensure attorneys perform their roles effectively and efficiently.

Administration of Non-Litigious Matters

  • Approve requests to appoint and instruct assessors and expert witnesses.
  • Guide recommendations for settlement.

Mediation Management

  • Manage communication between disputing parties to facilitate mutual agreement.
  • Conduct introductory meetings to educate parties about arbitration.
  • Handle procedural matters in dispute resolution.

Policy Review and Implementation

  • Contribute to the development and implementation of departmental policies, procedures, and processes.
  • Stay updated on effective policy and practice strategies.

Reporting

  • Prepare and submit regulation reports and other documentation to inform management decisions.
  • Develop reports, policies, and procedures aligned with RAF's strategy.
  • Create functional reporting systems for management and performance monitoring.

Stakeholder Management

  • Manage communication and relationships with internal and external parties, including the Judiciary and legal counsel.

People Management

  • Source, develop, and retain a high-performance team.
  • Implement people management processes to address workplace issues.
  • Allocate, motivate, and evaluate team members to achieve goals.

Qualifications and Experience

  • Bachelor's Degree in Law or equivalent.
  • Postgraduate law qualification and Mediation certificate/course are advantageous.
  • 6-8 years' experience in a legal environment, including 3 years in personal injury litigation and 2 years in management/supervision.

Technical and Behavioral Competencies

  • Excellent communication, negotiation, and dispute resolution skills.
  • Knowledge of litigation management, court processes, and relevant legislation.
  • Strong planning, organizing, and leadership abilities.
