Admission as an Attorney/Advocate A minimum of 5 years post-admission experience, 3 of which must have been in commercial law or in a related area of law and 2 of which must have been as a regulatory specialist position in the automotive or other relevant industry.
Experience in a legal practice is recommended.
Critical knowledge and experience on key regulatory legislation affecting Auto/Manufacturing Industry including but not limited to the Financial Intelligence Centre Act, Protection of Personal Information Act, Consumer Protection Act.
Post-Graduate qualification in the various fields of regulatory compliance will be an advantage.
Duties and Responsibilities:
Administer legal matters through the sound application of performance management principles and objectives, key performance indicators and development and training plans.
Critically review and comment on draft legislation.
Develop and maintain Company regulatory universe and provide quarterly reports.
Develop and maintain Company Risk Management and Compliance Programmes in key legislation affecting the group.
Support user areas by providing legal and business advice to ensure compliance.
Remain abreast of legal developments in general and specifically within the motor industry.
Coordinate and participate in specialist committees (such as Social & Ethics Committee).
Represent the Company at the NAAMSA legal forum on matters of common interest, specifically new legislation, without competition law implications arising.
Oversee and manage litigation / alternative dispute resolution proceedings initiated by or instituted against the Company with support from external legal practitioners in order to avoid/limit negative publicity and/or reputational damage.
Protect intellectual property of the Group.
Support the business in relation to Integrity, Risk & Compliance.
Identify training requirements relevant to the field of law and Group directives and to present such relevant training within the Company.
Support the training department when developing training modules relevant to the field of law.
Attend and participate in Group Conferences (Legal), when called upon to do so.
Make recommendations to the Group, on request, when dealing with African law firms.
Support the Group with all matters administered by the Group in Africa.
Meet with and co-operate with Group colleagues and colleagues from related Group subsidiaries as and when needed.
Ensure that the Legal Department and its representatives act ethically to uphold and promote the reputation of the Company in every respect.
Act as an office of record in relation to legal matters.
Support, research, compile and submit regulatory filings.
Respond to regulatory information requests by ensuring consistency, accuracy and timeliness.
Provide assistance in the coordination, research and preparation of in-depth regulatory evaluation.
Identify and suggest Organisational Directives to address new regulatory requirements.
Assist in the development of projects to comply with regulatory programs.
Coordinate reporting to stakeholders and management on new legislation.
Co-operate with Company’s external auditors in relation to the completion and submission of periodic reports requested by the auditors.
Review specified Board of Management presentations and advise if in conflict with legislation and/or Organisational Directives.
