Legal Counsel (Commercial Law and Foreign Market) - Cape Town

Description: Our client, in the Agricultural and Export Industry, is seeking a Legal Counsel to join their team in Cape Town.

Requirements:

  • LLB Degree or equivalent; Admission as an attorney/advocate.
  • 8-10 years of legal experience, preferably in international trade, agriculture, or FMCG industries.
  • Experience with intellectual property, licensing, and trade regulations in foreign markets.
  • Knowledge of South African corporate and regulatory compliance.

Responsibilities include but are not limited to:

  • Drafting, reviewing, and negotiating licenses for nurseries, commercial growers, and trial growers.
  • Negotiating and finalizing commercial contracts with global suppliers and customers.
  • Assessing contracts to ensure alignment with business objectives and risk management.
  • Providing guidance on contractual obligations and legal risks.
  • Researching and interpreting laws in new operating regions.
  • Developing and implementing grower licenses in new jurisdictions.
  • Managing the execution of licenses and contracts to support supply chain operations.
  • Advising on legal considerations in establishing and maintaining fresh produce supply chains.
  • Identifying and interpreting laws affecting fresh produce supply in South Africa, North Africa, and Europe.
  • Ensuring compliance with legal and regulatory requirements across regions.
  • Providing proactive legal guidance to mitigate risks.
  • Supporting litigation efforts through review of pleadings, discovery, and legal research.
  • Handling day-to-day legal issues in North Africa and Europe, including customs clearance.
  • Advising on corporate law and structuring in South Africa.
  • Coordinating with external legal counsel as needed.
