Description: Our client, in the Agricultural and Export Industry, is seeking a Legal Counsel to join their team in Cape Town.
Requirements:
- LLB Degree or equivalent; Admission as an attorney/advocate.
- 8-10 years of legal experience, preferably in international trade, agriculture, or FMCG industries.
- Experience with intellectual property, licensing, and trade regulations in foreign markets.
- Knowledge of South African corporate and regulatory compliance.
Responsibilities include but are not limited to:
- Drafting, reviewing, and negotiating licenses for nurseries, commercial growers, and trial growers.
- Negotiating and finalizing commercial contracts with global suppliers and customers.
- Assessing contracts to ensure alignment with business objectives and risk management.
- Providing guidance on contractual obligations and legal risks.
- Researching and interpreting laws in new operating regions.
- Developing and implementing grower licenses in new jurisdictions.
- Managing the execution of licenses and contracts to support supply chain operations.
- Advising on legal considerations in establishing and maintaining fresh produce supply chains.
- Identifying and interpreting laws affecting fresh produce supply in South Africa, North Africa, and Europe.
- Ensuring compliance with legal and regulatory requirements across regions.
- Providing proactive legal guidance to mitigate risks.
- Supporting litigation efforts through review of pleadings, discovery, and legal research.
- Handling day-to-day legal issues in North Africa and Europe, including customs clearance.
- Advising on corporate law and structuring in South Africa.
- Coordinating with external legal counsel as needed.
