Job description

An established agrochemical manufacturer is seeking the above to provide legal support to the Crop Science Business Group and enabling functions as well as attending to concomitant legal duties.

POSITION INFO :

Minimum requirements for the role :

  • Must have a legal qualification (LLB or similar) and admission as Attorney
  • Minimum 7 years’ post qualification legal experience
  • Sound knowledge of Intellectual Property Law, Antitrust Law, Law of Contract and Labour Law is essential
  • Extensive legal crop science (crop protection, seeds, related services) industry experience is highly preferred
  • Sound communication abilities and commercial and negotiating skills are advantageous
  • Must be fully computer literate in SAP, Word, Excel, and PowerPoint

The successful candidate will be responsible for :

  • Supporting the Crop Science Business Group and enabling functions by providing advice and counsel in relevant areas of law to further the interests of the business, while bearing in mind the protection of the company’s common law and statutory rights, license to operate, (intellectual) assets and interests.
  • Negotiating commercial and other applicable agreements, as well as drafting - as required.
  • Considering and commenting on agreements and amending as required.
  • Drafting contractual amendments, termination notices, letters of demand, etc.
  • Supporting litigious matters as required (with the support of appointed external counsel, where appropriate).
  • Negotiating repayments and initiating debt collection proceedings from a legal perspective.
  • Perusing new legislation and advising on its applicability to the company and specifically the business.
  • Advising on business strategies.
  • Coordinating and drafting legal responses.
  • Managing and supporting external counsel.
  • Reviewing third party Terms and Conditions of Trade where we are not successful in enforcing our standard T&Cs of Purchase.
  • Regularly providing training sessions for the business on legal issues of interest.
  • Managing anti-counterfeiting initiatives and matters in Southern Africa in conjunction with global colleagues and local counsel, as required.
  • Working in close cooperation with the Global Legal, Compliance, and IP teams, key external stakeholders e.g. Government / regulators / trade associations.
  • Providing leadership in anticipating, evaluating, and addressing potential business opportunities and legal challenges within South Africa and the region.
