Our client a leader in Commercial Property Development is seeking a highly skilled Legal Commercial Leasing Agent with an LLB qualification to join their team and focus on managing and negotiating commercial property leases particularly for retail clients . The ideal candidate will have expertise in legal leasing processes ensuring compliance with relevant laws and regulations and managing energy license agreement renewals for commercial and retail properties . This role will focus on the legal aspects of leasing including drafting negotiating and ensuring legal compliance throughout the leasing process.

Duties & Responsibilities

Key Responsibilities :

Leasing Strategy and Legal Oversight :

  • Formulate and implement leasing strategies for commercial properties ensuring all agreements are legally sound and comply with relevant laws and regulations.
  • Provide legal guidance on best practices for leasing specifically for retail properties ensuring all leases are structured to comply with South African commercial property law.

Negotiation & Lease Agreement Drafting :

  • Lead negotiations for lease agreements ensuring that all terms are legally compliant and aligned with market standards.
  • Draft and review lease agreements amendments and renewals ensuring accuracy and legal enforceability.
  • Provide detailed legal analysis of lease terms highlighting any areas of concern and advising on the most appropriate course of action.
  • Legal Compliance & Regulatory Adherence :

  • Ensure all leasing activities comply with local provincial and national laws including but not limited to the Rental Housing Act Property Practitioners Act Consumer Protection Act and other relevant legislation.
  • Oversee the legal process of lease renewals ensuring that all renewals are compliant with regulatory requirements and best practices in commercial property leasing.
  • Energy License Agreements & Legal Compliance :

  • Manage the renewal of energy license agreements for commercial and retail properties ensuring all processes comply with energy regulations and relevant legislation.
  • Draft and negotiate energyrelated agreements ensuring all terms align with legal requirements and support the overall leasing strategy for commercial properties and retail clients .
  • Legal Documentation & Record Keeping :

  • Ensure all legal documentation related to commercial and retail leases is meticulously drafted reviewed and maintained in compliance with company policies and legal standards.
  • Keep uptodate records of all legal agreements ensuring that all documents are stored securely and are easily accessible when needed.
  • Lease Renewal & Legal Reviews :

  • Oversee the legal aspects of lease renewals for both commercial and retail properties ensuring that all renewal terms are legally sound and appropriately negotiated.
  • Provide legal advice and insights into renewal negotiations ensuring compliance with relevant laws and regulations.
  • Legal Risk Management :

  • Identify and mitigate potential legal risks associated with lease agreements including risks related to tenancy laws energy compliance and property regulations.
  • Work with the legal team to resolve any legal disputes including lease terminations noncompliance issues or other legal challenges that arise during the leasing process.
  • Qualifications & Requirements :

  • LLB degree (Bachelor of Laws) is a mandatory qualification.
  • Proven experience in commercial property leasing with a strong emphasis on legal requirements and compliance.
  • Expertise in drafting negotiating and reviewing commercial and retail lease agreements with a strong understanding of property law .
  • Experience in the renewal of energy license agreements and familiarity with the legal aspects of energy regulations.
  • Strong knowledge of relevant South African property laws including the Rental Housing Act Property Practitioners Act Consumer Protection Act and other commercial leasing regulations.
  • Excellent attention to detail with the ability to identify and resolve legal issues related to leases agreements and compliance.
  • Strong legal research skills and the ability to stay updated on changes in commercial property law.
  • Proven ability to work independently and manage multiple legal processes simultaneously.
  • Proficient in Microsoft Office Suite; experience with leasing management software is a plus.
  • Desirable :

  • Experience with retail property leasing and a deep understanding of the unique legal considerations for retail clients.
  • Strong understanding of the legal process related to tenant improvements and customization requirements in commercial and retail properties.
