Legal Advisor Position

An exciting opportunity has become available within the construction industry, for a Legal Advisor.

The position is based in Plattekloof, Cape Town.

Duties & Responsibilities
  1. Legal support: Providing general legal support to the different divisions of the company: Finance & Management Support / Management Program / FCA's / Professional Services.
  2. Drafting of legal documentation, including contract templates, default notices, PSP appointment letters, etc. (e.g., Sub-consultant, PROCSA and CIDB templates and Addenda).
  3. Vetting and compliance: All legal documentation drafted on behalf of third-party funders.
  4. Monitoring ongoing litigation and disputes, vetting court documentation where applicable.
  5. Liaising with employers and/or Consultants on legal matters on behalf of the company and/or clients.
  6. Attending to registration of securities and signing of irrevocable payment undertakings and perfecting of securities.
  7. Attending to legal correspondence with all relevant stakeholders, including employers, clients, and third parties.
  8. Assisting with special tasks on an ad hoc basis.
  9. Assist in monitoring legal risk & compliance: Identifying and managing potential legal risk.
  10. Ensuring that all suspensive conditions are met prior to Clearance being given (FMS).
  11. Ensuring that all contract documents are correctly executed.
  12. Attending to recoveries and debt collection.
  13. Assist with debt collection on behalf of the company: Drafting of LOD / AOD and monitoring repayments.
  14. Setting and meeting collection targets as per agreement.
  15. Instructing external attorneys per requirement.
  16. Attorney liaison and responding to queries and requests for information.
  17. Assisting with trial preparation – documentary evidence, briefing of witnesses, etc.
  18. Report on legal matters: Drafting and submitting of reports to Legal Manager as required.
  19. Attending to in-house HR administrative matters.
  20. Drafting offers of employment & employment contracts.
  21. Assisting with disciplinary matters including the drafting of disciplinary documentation (e.g., charge sheet / record / outcome).
  22. CCMA: Attendance of hearings / Hearing preparation & trial bundles.
  23. Redrafting of Company HR Policies & Procedures and Policy Review: Monitoring input from external and internal stakeholders and driving to completion.
  24. Monitoring performance gradings and providing guidance to the relevant Executive.
Desired Experience & Qualification
  1. Paralegal Diploma / Law Degree.
  2. Relevant experience in either private practice or in-house legal division.
  3. Previous exposure to the built environment will be advantageous.
