Legal Advisor Position
An exciting opportunity has become available within the construction industry, for a Legal Advisor.
The position is based in Plattekloof, Cape Town.
Duties & Responsibilities
- Legal support: Providing general legal support to the different divisions of the company: Finance & Management Support / Management Program / FCA's / Professional Services.
- Drafting of legal documentation, including contract templates, default notices, PSP appointment letters, etc. (e.g., Sub-consultant, PROCSA and CIDB templates and Addenda).
- Vetting and compliance: All legal documentation drafted on behalf of third-party funders.
- Monitoring ongoing litigation and disputes, vetting court documentation where applicable.
- Liaising with employers and/or Consultants on legal matters on behalf of the company and/or clients.
- Attending to registration of securities and signing of irrevocable payment undertakings and perfecting of securities.
- Attending to legal correspondence with all relevant stakeholders, including employers, clients, and third parties.
- Assisting with special tasks on an ad hoc basis.
- Assist in monitoring legal risk & compliance: Identifying and managing potential legal risk.
- Ensuring that all suspensive conditions are met prior to Clearance being given (FMS).
- Ensuring that all contract documents are correctly executed.
- Attending to recoveries and debt collection.
- Assist with debt collection on behalf of the company: Drafting of LOD / AOD and monitoring repayments.
- Setting and meeting collection targets as per agreement.
- Instructing external attorneys per requirement.
- Attorney liaison and responding to queries and requests for information.
- Assisting with trial preparation – documentary evidence, briefing of witnesses, etc.
- Report on legal matters: Drafting and submitting of reports to Legal Manager as required.
- Attending to in-house HR administrative matters.
- Drafting offers of employment & employment contracts.
- Assisting with disciplinary matters including the drafting of disciplinary documentation (e.g., charge sheet / record / outcome).
- CCMA: Attendance of hearings / Hearing preparation & trial bundles.
- Redrafting of Company HR Policies & Procedures and Policy Review: Monitoring input from external and internal stakeholders and driving to completion.
- Monitoring performance gradings and providing guidance to the relevant Executive.
Desired Experience & Qualification
- Paralegal Diploma / Law Degree.
- Relevant experience in either private practice or in-house legal division.
- Previous exposure to the built environment will be advantageous.
