Legal Advisor

Legal Advisor position available in Stellenbosch.

Duties and Responsibilities:

1. Drafting, Reviewing and Vetting:
   1. Draft and review contracts related to property acquisitions, leases (including, triple net, double net leases), sales, and development projects, JBCC Contracts, PROCSA contracts and other suites of contracts relevant to the building / property industry.
   2. Drafting and reviewing of commercial property contracts including development agreement and agreements with service providers (e.g. Quantity Surveyor, Architect, Principal Agent, Construction companies).
   3. Manage contract administration processes, including renewals, terminations, and amendments.
   4. All other drafting obligations such will include but not be limited to Sale of Shares, Power of Attorneys, Addendums, Cession Agreements, Suretyships, Guarantees, Resolutions, etc. as and when directed.
2. Litigation matters:
   1. Instigate and defend all litigation to protect the interests of the Group.
   2. Manage the litigation process with external attorneys.
3. Debt Collection:
   1. Oversee and monitor all debt collections processes of the Group.
   2. Ensure the attendance of rent roll meetings and other internal collections processes.
   3. Drafting of Letters of Demand, Notices to Vacate, Acknowledgments of Debts, etc.
   4. Negotiations with debtors in respect of settlement of arrears.
4. Research/opinions:
   1. Research new developments in property law or legislation which impact on property law where necessary and as required.
   2. Research and prepare opinions and summaries of salient facts which require the interpretation of the law.

Requirements:

1. LLB Degree or equivalent.
2. Admission as an Attorney or Advocate (pupillage served).
